He was paymaster in Col. John Tillotson's regiment of Cayuga County, N.Y., militia in 1810; moved from the county before 1814. The division of his estate gives the names and locations of many of his relatives.

"Petition of Henry Hewett of Venice [N. Y.], sworn to March 15, 1847, shows that Cyrus Avery of Moravia, died February 24, 1847; that he left a will dated April 17, 1838, by which he appoints his wife executrix. The petition states that she has died. The petition further shows that he left as next-of-kin, Hezekiah, Daniel and Rebecca Morgan of Ledyard, Charles of Brutus, and Henry of Wayne County, Pa., being brothers and sisters of the deceased. He further left Ebenezer of New Milford, Pa., Phebe Hussey, Elias Morgan, Erastus Morgan, Ebenezer Morgan, Betsey Avery of Collins, N. Y., Fred Morgan of Caroline, N. Y., Amasa Avery of Burlington, N. Y., Russell Williams of Parkman, Ohio, Elisha Morgan of Gallipolis, Ohio, Ann Morgan, widow of Dudley Morgan, deceased, of Huion County, Ohio, Egbert Avery of Norwich, Samuel R. Avery and Lucy Mitchell of Groton, Henry Avery and Nathan Denison of Mystic, Conn., Sydney Avery of Belvidere, 111. Also the children of the deceased wife of John O.
