About John Payne, Sr.

He was born in Maryland, moved to Bedford County, Virginia, to Franklin County, Virginia, to Jackson County, Tennessee, and finally to Lawrence County, Ohio.

In 1801 John Payne purchased land from Benjamin Allen Pate, land that lay on both sides of the Staunton River. The north side was Bedford County and the south was Franklin County, Virginia. From this we can see that John Payne and Benjamin Allen Pate families were connected in Virginia. Benjamin moved to Breckinridge County when he sold this land. Later in Breckinridge County their granchildren married. It was proven that they lived in Bedford County on 2 September 1799 when their daughter Elizabeth married james Moorman. Her brother Ellis, in an affidavit to the War Department stated, "They were married at my father's house in Bedford County, Virginia." It is believed they moved to Franklin County after 1801 when they purchased the Pate property. John, listed as John Payne, Sr., was found in the 1810 Franklin County census.

John may have moved for a short time to Jackson County, Tennessee. At least he paid property tax there. Some of his sons had moved there. All Jackson court records were destroyed by fire and the only records available are tax records that were stored in Nashville, Tennessee.

By 1816 John Payne had moved to Gallia County, Ohio where he purchased cheap virgin government land. The area became Lawrence county, Ohio. In Lawrence County on 12 July 1829 John Payne, Sr. married second to Nancy Carpenter and John Payne was found in the 1830 Lawrence County census. This would prove John did not die in 1826. Back in Franklin County, Virginia there was a deed dated 17 February 1836 when the Martin family sold land south of the Staunton River to John K. Ferguson and the boundaries included the heirs of John Payne. In Lawrence County, Ohio, the settlement of estates for 1836 and 1837 were lost. John Payne was not found before 1836 or after 1837 in settlement records. The Fairview Cemetery (Baptist Church) is located on the old John Payne property and there are fieldstone markers on the back of the lot. It is believed John Payne was buried there.
