There is some mystery about this Asa Phelps' parents.
"To clarify this further, we DO know that Asa (Sally) Phelps' father was Asa. We just cannot prove the elder Asa's birth, death, marriage, and their locations, who were the other children he may have had, etc.. Many say they are Asa Phelps and Martha Bronson but we just are unable to really prove that. And on top of that this elder Asa may actually be somehow connected to Philip Phelps' clan. We just can't find his parents with strong certainity either." (Phelps family researcher)

The people of the State of New York by the grace of God, for and independent to all whom these presents may come or shall concern, and especially to Sally Phelps, the widow of Asa Phelps deceased, Bradford Phelps, Hiram Phelps, Joel Phelps, Jesse Phelps, Lucy Brown the widow of Rufus Brown deceased, Harriet Phelps and Mallisa Grimes wife of Joseph Grimes, all of whom reside in the town of Candor, County of Tioga and State of New York, John M. Parker, special guardian of Othniel Phelps, Amanzo Phelps and Selina Phelps, infants under the age of twenty-one years, resident of the town of Owego in said county of Tioga, the said wards all residing in the town of Candor aforesaid, Electa Hendrick, wife of Martin Hendrick, resident of Stockbridge, County of Berkshire, State of Massachusetts, Jason Phelps, resident of Rushford, Alleghany County, State of New York, Sally Felter wife of Matthew Felter, resident of Blenheim, Schoharie County, New York, all heirs at law and next of kin of Asa Phelps deceased, you and each of you are hereby cited, notified and required personally to be and appear at a Surrogate's Court to be held before our Surrogate of the County of Tioga at his office in the Village of Owego insaid County on the 21st of September 1840... etc.
Asa Phelps Will: In the name of God amen, I Asa Phelps of the town of Candor in the County of Tioga and State of New York, being of sound and disposing mind, memory and understanding, do hereby make and declare this to be my last will and testament as follows, to wit:
ITEM - I will and direct that all my just and legal debts and funeral charges be paid by my executors hereinafter named.
ITEM - I give and bequeath to my beloved wife Sally all my household goods, bedstead, beds, bedding and other furniture for and during her natural life, and after her decease, I give and bequeath the same to my daughters living at the time of her decease equally to be divided between them.
ITEM - I give and devise unto my beloved wife, Sally in lieu of her dower, during her natural life the use, income, credits and profits of one-third of the farm called my homestead, containing about one hundred and eighty-three acres whereon I now reside, and also the use and possession of one-third of the dwelling house, out houses on said farm and the privileges therewith belonging.
ITEM - I give, devise and bequeath to my sons, Joel Phelps, Asa Phelps, Jesse Phelps, Othniel Phelps and Amanzo Phelps, their heirs and assigns my said homestead farm before mentioned subject to the demise of my said wife Sally therein as aforesaid; and also all other lands that I shall die desired of, and also all land that I shall hereafter [illegible] and shall remain unpaid for at the time of my decease, equally to be divided between them; and also all my stock of cattle (except our cow which shall go to my said wife and two sheep during her natural life), horses, sheep, hogs and other domestick animals, waggons, carriages and farming utensils of every description, after paying off and discharging all my legal debts.
ITEM - I give and bequeath to my sons, Bradford Phelps, Hiram Phelps and Jason Phelps as follows, to wit, to Bradford, fifty dollars; to Hiram three hundred dollars and to Jason three hundred and fifty dollars; and I give and bequeath to my daughters Electa, Sally, Lucy, Harriet, Malissa and Salina six hundred and fifty in measure following, to wit, to Electa one hundred dollars, and in case of her death then to her heirs; to Sally one hundred dollars and in case of her death then to her heirs; to Lucy one hundred dollars and in case of her death then to her heirs if any; to Harriet one hundred dollars and in case of her death then to her heirs if any; To Mallisa one hundred dollars and in case of her death then to her heirs if any; and to Salina one hundred fifty dollars and in case of her death then to her heirs if any living.
ITEM - I will and direct that my five sons, to wit, Joel, Asa, Jesse, Othniel and Amanzo, to whom I have given my real estate shall in equal proportions pay each and every of the respective legacies above named to my sons and daughters above named to whom legacies are bequeathed, and to secure the payment of the respective legacies upon the real estate devised to my said sons last above names. It is also my will that should either Bradford, Hiram or Jason die before the receipt of their said legacies, that then and in that case, the legacy shall be paid to his or their heirs, and that each and every of the legacies above mentioned shall be paid within two years after the death of my wife Sally, should she out live me and should she not then and in that case within two years after my death.
It is hereby understood that the devise to my beloved wife Sally in lieu of dower, is upon the condition that she remains my widow and unmarried after my death; and in case she should marry then and in that case the devise to her is to cease and be in operation.
ITEM - I give and bequeath all the rest and residue of my personal estate and effects not herein otherwise disposed of (after payment of my debts, legacies and funeral charges) to my said sons and daughters equally to be divided between them, share and share alike. Lastly, I do hereby nominate and appoint my said son Asa Phelps, Jr and Asa Hall executors of this my last will and testament, hereby revoking all and any former wills by me made.
In witness whereof, I, Asa Phelps of Candor have on this eighteenth day of June in the year of our Lord one thousand eight hundred and forty, signed, sealed and declared by the testator, Asa Phelps, to be the last will and testament in the presence of us, who at his request in his presence and in teh presence of each other subscribed oru names as witnesses: E. Smith Sweet and Wm. P. Stone of Owego, Tioga County. Asa Phelps L.S. Recorded Oct. 1st, 1840; N. W. Dair, Surrogate.
