Benjamin Burch was the son of John W. and Margaret Sappington Burch. Married 1: Elizabeth Jones on September 15, 1868 in Morgan County. Married 2: Mrs. Lucy (Austin) Hart son September 6, 1886 in Morgan County. They divorced in May of 1902. Also in May of 1902, Benjamin sued Lucy's son, Charles Hart for alienating Lucy's affections for Benjamin.

Co I, 14th Ill. Inf. (Union Army, spent 6 months in Andersonville Prison)

Died at his home, 2 miles southeast of Franklin. He was survived by seven children: Mrs.Porter Turner Mrs. Robert Jones Mrs.William Hughes Ellsworth Burch Harry Burch Mrs. Eula Skeens Howard Shelby Burch.
