Will of Daniel Shultz, dec’d

I, Daniel Shultz, of the township of Greenwood and County of Columbia and State of Pennsylvania, farmer, being weakly of body but of a sound mind and memory and calling to mind the uncertainty of life and the certainty of death Do make and claim this my last Will and Testament in the manner and form following that is to say first and principally I commit my soul in the hand of the Almighty God who gave it and my Body to be Buried in a descent and becoming manner at the discretion of my Executors hereafter named and Secondly I order all my just debts and funeral expenses to be paid and discharged by my Executors as soon as may be out of my Estate then give and bequeath unto my beloved wife, Elizabeth, my Plantation wherein I now dwell containing one hundred and ten or twelve acres with the apurtinences thereunto belonging to her use and benefit together will all my household and kitchen furniture with one or two cows and six sheep and also all the residue of the money that may be left after my debts are paid as aforesaid all of which give and bequeath to her and for her use and benefit during her natural life and no longer from and after which time and as is convenient my will further is that my plantation be sold either at public or private sale for the best price that can be conveniently had for it. I hereby empower my Executors hereafter named to make as good a title or titles to the purchaser or purchasers as I myself might or could have done when I was personally present and I further order that all my personal property that my wife may have in her possession of at the time of her decease be sold either at public or private sale and her debts and funeral charges to be paid and my Executors to be paid and all the money arising from the personal property and my plantation I give and devise to my seven children namely JOHN, PHILLIP, SAMUEL, JAMES, SARAH, WILLIAM and ISAAC to be equally divided amongst them share and share alike only such requests as I shall name in maintain with the heirs of my deceased children first SAMUEL’s oldest son, ISSAAC is to have only five dollars out of his father’s share and the remainder to be equally divided amongst the rest of his other children that are living at that time, where it is settled. Secondly, I order that my son JAMES have the one half go to his son JOHN and the remainder to be equally divided with JOHN’s three sisters. Thirdly WILLIAM’s share the one half to go to his son JACOB and the remainder to be equally divided amongst the rest of WILLIAM’s children share and share alike and further my Will is that if any of my heirs children or grand children finding fault or cause any rupture in Law suit shall be put off with one dollar only and I order my Executors to take their pay as the law directs for their service out of my Estate and I order when my plantation is sold wherein I now dwell to except one acres of land where the graveyard now is to be enlarged when necessary northward and eastward and a bar road in cart way to and from the same free and clear for all persons and I order one hundred dollars of my Estate to get marked tomb stones and to put them up beginning at my father and mother and mother-in-law and so down as far as it will go and last I constitute and appoint my trustees and friends John Richart, Esquire and William Mather to be my whole and sole Executors to this my last Will and Testament dissolving and revoking all other wills heretofore by me made declaring this and no other to be my last Will and testament in testimony whereof I set my hand and seal this fourth day of June A. Codial- I Daniel Shultz of the Township of Greenwood and County of Columbia and State of Pennsylvania being at this time weak of body but of sound mind and considering the certainty of death and wishing to settle my worldy affairs do publish this an addition or codial to my Will which is dated the fourth day of June A. D. 1844 First I give to my grandson, John B. Shults the lot in which I now live being the corner lot at the road that leads to the Mill of Eres to co. situate in Greenwood Township and I give also to John B. Shults the wood lot that I bought of Appleman. Paying on the hill joining the lands of John Richart and other lands of Appleman the two lots above mentioned belong to the said John B. Shults immediately after the death of myself and wife and not before in testimony whereof I have hereunto set my hand and seal this second day of January 1852.
