Daniel Tebbs Will

  • In the name of God Amen, I Daniel Tebbs of the parish of Cople and county of Westmoreland being in good health of body and perfect mind and memory do make and ordain this to be my last will and testament.
  • Imprimis, I give and bequeath to my son William Tebbs the land I purchased of Samuel Earle, Presley Cox and part of Thomas, to be from the head of the branch below my orchard a straight line to a white oak standing in the edge of Samuel Rust’s old field that was formerly a corner to Thomas and Earle, and all the land I bought of Charles Eskridge, also a mill called Courtney’s Mill, and a Negro boy named Young Topsom.
  • Item I give to my dear beloved wife Elizabeth the use of my dwelling plantation with 300 acres of land adjoining thereto to be taken out of my son Daniel Tebbs part of land with her choice of three of my Negroes during her natural life.
  • Item I give unto my son Daniel Tebbs Negro Till, and all the other part of my land with the mill called the Church Mill.
  • Item I give to my daughter Mary Tebbs three Negroes; Nan, Janney and Nelly.
  • Item I give to my daughter Elizabeth Tebbs to Negroes; Frank and Johney.
  • Item I give all the rest of my Negroes to be equally divided between my children, Daniel Tebbs, Mary Tebbs, Elizabeth Tebbs, and William Tebbs.
  • I therefore give my executors full power and authority to make over lawful deeds for that land I sold to John Garner, lying in Prince William County according to the said Garners will, as the deed I gave him relapsed before it was proved on the south side of Broad Run.
  • I do hereby constitute and appoint my beloved wife Elizabeth Tebbs (if she should be the longest liver) my friends the Hon. Philip Ludwell Lee, Esq., and Samuel Rust my executors and guardians to my children till they come of age.
  • In witness whereof I have hereunto set my hand and seal this 25th day of May 1760
  • Sealed and delivered in presence of Daniel Tebbs
  • At a court held for Westmoreland County the 22nd day of February 1762 this last Will and Testament of Daniel Tebbs, deceased was presented into Court by Samuel Rust, one of the executors therein named and no witnesses being subscribed thereto Thomas Bennett, Jr. and Richard Atwell severally made oath that they are well acquainted the testators handwriting and verily believe the said will and the name thereto subscribed to be the proper hand writing of the said testator and therefore it is ordered that the same be recorded. And on the motion of the said Samuel Rust who made oath according to law and together with Willoughby Newton and Joseph Lane his securities entered into and acknowledged bond with condition, as the law directs, certificate is granted him for obtaining a probate thereof in due form.
