Henry Fitz born about 1705, died after 1760 Prince George Co., VA is thought to be the father of Henry d. 1804 of Warren Co., NC. Parish record shows marriage of Henry Fitz to Ann Sentall September 26, 1734. Court records for the estate of Nicholas Vaughan indicate Henry Fitz married Ann, widow of Nicholas Vaughan before August 14, 1739. No death record for Henry Fitz has been found, nor names of children or siblings in land records. Henry Fitz certainly was not the only Fitts or Fitz in Prince George/Dinwiddie; his are just the only records which have survived. Henry received land grants made to him by patents issued by the Governor, W. Gooch, as appears on the Virginia Land Registry in the State Land Office: Henry Fitts, 400 acres in Prince George County on the head of Leadbekeis River (Creek), February 9, 1737, adjoining Laughlin Flyn's line. (Thomas P. Hughes, Jr., Dinwiddie Co VA Data 1752-1865, Memphis TN, 1975) In 1738, Henry was the overseer of Hatchers Run. Four hundred acres in Prince George County on Nammisseen/Namozine Creek and adjoining the lands of Robert Bolling and John Fitzgerald, September 5, 1749. Two hundred and four acres in Prince George County, on both sides of Mawhoponock/Whipponock Creek, and adjoining the land of Edward Traylor, December 15, 1749. In 1753, land adjoining Henry Fitz was held by William Vaughan and William Eppes and Thomas Reese at Cock's Road in Dinwiddie County. (Thomas P. Hughes, Jr., Dinwiddie Co. VA Data 1752-1865, Memphis, TN, 1975) This portion of Prince George County later became Dinwiddie County, and Namozine Creek, on which Henry had land, is the dividing line between current Dinwiddie and Amelia counties. Leabetters Creek and Whipponock Creek are both just west of the Petersburg city limits and flow into the Appomattox River. Namozine Creek is about 2 1/2 miles further West. Henry is named with land adjoining that of Vaughan, Reese and Eppes in 1753. On March 30, 1760, John Pemberton was granted 108 acres on both sides of Cockes Road between William Eppes, William Vaughan, Henry Fitz and Thomas Reese, now called Dinwiddie County. It is assumed that Henry was still living in 1760.

There are other Fitts in Dinwiddie & Halifax Counties, whose relation is not proved to Henry Fitts, including: Elisha Fitts who is shown on the 1771 Granville Co. NC tax list. In Halifax Co. VA, there are John Fitts, Tandy Fitts and Robert Walker Fitts, born in late 1750's, early 1760's, apparent sons of a Walker Fitts d.c. 1810. Since the early records for these counties did not survive, the relation of Henry Fitz to other Fitz/Fitts in the area cannot be proved. There is only the thinnest connection where descendants of Walker Fitts d. 1810 were in the same part of Alabama as those of Henry d. 1804 and that Henry’s son bought property near that of Walker’s descendants in Mecklenburg Co., VA in the 1820s.

The ancestry of Henry Fitts as provided by James Harris Fitts in “Fitts or Fitz Family in America” is flawed and any connection to Robert Fitts at Jamestown or the Fitz of Tavistock, Devonshire, cannot be proved. There were other Fitts besides Robert of Jamestown. There was a Carry Fitts of 1648 Gloucester, 1657 Westmoreland and 1662 New Kent, VA; John Fitts of 1681 New Kent; Robert Fitts of 1650 who patented land on the south side of the Potomac River; and Thomas Fitts of 1669 New Kent or Charles City Co. VA.

First Proved Generation

         1.  Henry1 Fitts (Jr.), son of Henry Fitts (Sr.)xe "Fitts:Henry, (Sr.) (ABT 1705-AFT 1760)", was born in Bristol Parish, Prince George Co., VA July 18, 1734.  Henryxe "Fitts:Henry, (Jr.) (1734-BEF 1804)" died before May 21, 1804 in Warren Co., NC.  Raleigh Register of May 21, 1804 states Henry Fitts, Sen. died 'a few days ago.'
         Hexe "Fitts:Henry, (Jr.) (1734-BEF 1804)" married Susannah Sturdivantxe "Sturdivant:Susannah (1746-ABT 1802)" about 1770.  Susannahxe "Sturdivant:Susannah (1746-ABT 1802)" was born in Albemarle Parish, Sussex Co., VA May 14, 1746.  Susannah was the daughter of Matthew Sturdivant (II)xe "Sturdivant:Matthew, (II) (ABT 1718-dec.)" and Sarah Oliverxe "Oliver:Sarah ( -dec.)".  Susannahxe "Sturdivant:Susannah (1746-ABT 1802)" died about 1802 in Warren Co., NC.  Susannah was living at the time of her husband's will. 
         Hexe "Fitts:Henry, (Jr.) (1734-BEF 1804)" made a will in Warren Co., NC, January 2, 1802.  Henry Fitts, d. 1804, is the first "proved" generation of this family. That Henry was the son of Henry Fitts & Ann Sentel or Ann Vaughan, widow of Nicholas, is not proved but based on circumstantial. Probate August Court, 1804, proved by oaths of Andrew Small and John Ellis. He named his wife and children. He left his 250 acre plantation and all the rest and residue of his estate, real and personal, to Susannah. After her death, one Negro Fanny and all the increase she may have was to go to son, Oliver. He had already made a deed to son Henry. Except for Negro Fanny, the estate was to be equally divided among his four children: O. Fitts, Sally Fussell, Nancy Brame and Henry Fitts junr.

He was in Bute Co. NC by 1773. Deed dated October 23, 1773, the 13th year of the Reign of Sovereign Lord, King George III, between Isaac Howell and Henry Fittz of Dinwiddie County, Virginia, for the sum of 300 pounds current money, 320 acres lying on both sides of Hawtree Creek, being the upper part of land formerly belonging to John Hawkins in the Province of North Carolina and county of Bute, granted by deed to Charles Poytheress of Dinwiddie, adjoining Joshua Ellis, thence down to Traver's Roe's dividing line; thence across the creek to John Jones' line...with all woods, underwoods, ways waters, water courses, mines, houses, gardens hereditaments and appurtenances thereto belonging or appertaining, and the revision, remainders, rents issues and profits thereof...Signed by Isaac Howell and witnessed by Henry Sturdivant, Travis Rees, Ephraim Ellis and William Ellis. In 1779, Henry obtained another land grant from the State of North Carolina, issued by Governor Richard Caswell.

1800 census of Warren Co. NC shows Henry and Sarah age 45+, with another female 45+ and 16 slaves.

NOTE: some early minutes from Warren Co. NC Court of Pleas & Quarter Sessions have been transcribed, as have some early census records, and the transcribers have noted other Fitts in Warren County prior to 1805. Among these are Isham, James, Nathaniel, Randolph, Rowland, Solomon. On looking at the original records and some other records, this surname is FELTS. There appears to be a William Fitts in early Warren Co.; he may be Felts. There is a Henry Fitts b. 1853, who married Bettie by 1880 census, she's age 25, with children: John 5, Ellen 3, Evelyn 5 mo., in Warren Co., Hawtree District, in 1880 and no connection has been found to the descendants of Henry Fitts d. 1804. A Henry Fitts b.c. 1825 ?Person Co., NC m. Winnie P. H. Hayes in 1845 Granville Co. and was in Franklin Co. in 1860. (this latter Henry Fitts probably connects to one of the Virginia lines that went into Person County; one of his daughters, Henrietta, married James Atlas Harris).

Second Generation

         2.  Oliver2 Fitts (Henry1) was born in Dinwiddie Co., VA 1771.  Oliverxe "Fitts:Oliver (1771-ABT 1816)" died about September, 1816 in St. Stephens, AL.  Raleigh Register October 18, 1816 says Oliver Fitts, Esquire died 'a few weeks ago.'
         He married twice.  Hexe "Fitts:Oliver (1771-ABT 1816)" married Sarah Harrisxe "Harris:Sarah ( -1811)" 1795.  Sarah was the daughter of James Harrisxe "Harris:James ( -dec.)" and Winifred(wife of James Harris)xe ":Winifred, (wife of James Harris) ( -dec.)".  Sarahxe "Harris:Sarah ( -1811)" died January 20, 1811 in AL.  It is not proved that Sarah was the daughter of James and Winifred Harris of Halifax Co. NC. James Harris Fitts indicates Sarah Harris as being from Surry Co., VA. Winifred, widow of James Harris Sr., sold her dower to Oliver Fitts in 18(03). James Harris' sister, Phereby, and her husband, James Harris, also sold their fourth of James Harris Sr.'s land to Oliver Fitts in 1802, as did Norfleet Harris sell his fourth to Oliver Fitts in 1800. The fourth one-fourth parcel was sold by Philip G. Alston and his wife Mary to Oliver Fitts in 1802; it is thought Mary Alston is sibling to James, Phereby and Norfleet Harris. The mother of James, Norfleet, Phereby and Mary, Temperance Harris, wife of James Harris, named James, Norfleet, Phereby, Mary, Samuel and Elizabeth in her 1783 will (abstracted by Olds). Adding to circumstantial evidence, Sarah & Oliver Fitts named children James Harris Fitts and Temperance Winifred Fitts. 
         Hexe "Fitts:Oliver (1771-ABT 1816)" married Peggy Bignell (widow of Edward)xe "Bignell:Peggy, (widow of Edward) ( -dec.)" in Warren Co., NC, July 15, 1813.  According to James Harris Fitts' book, Oliver was born in Dinwiddie Co., VA and brought to Warren Co., NC with his parents. He was a lawyer and Attorney General of the State of NC from 1808-1810. He was a member of the House of Commons from Warren County in 1798-1799. On April 17, 1810, he was nominated by James Madison, President, as Judge of the Mississippi Territory and the nomination was confirmed by the Senate the next day. Alabama was included in the Mississippi Territory and the Federal Courts were held at Vicksburg, MS and St. Stephens, AL. Oliver married first Sarah Harris of Surry Co., VA. Raleigh Register shows marriage of Oliver Fitts to Mrs. Bignell, widow of Edward Bignell, Esq. In "Fitts or Fitz Family in America," James Harris Fitts said Oliver married 2nd a Mrs. Ash. Oliver's widow married Gen. Buchanan.

Oliver's home in Warrenton, NC is located at 210 Plummer Street. It was probably built between 1805-1810. The home was later used by Jacob Mordecai as a school for girls, a Black school, the Warren Academy for Boys and home of the Plummers. Annie Fitts Lamm (a descendant of Oliver's brother, Henry) lived there before her death. It was purchased from Annie's estate by Mr. Hunter and has been restored by him to its original design and is on the walking tour of Warrenton.

Warren County NC Minutes of Court of Please & Quarter Sessions 1801-1805 by Ginger L. Christmas-Beattie: Oliver Fitts name appears in court a dozen times, including: February 23, 1802 Court ordered that the county trustees pay Oliver Fitts, Esquire State Attorney, fourteen pounds for his services for said county. (p. 98) Saturday, February 27, 1802 Henry Fitts, Sr. acknowledged a deed to Oliver Fitts, which was ordered. (p. 120)

Susanxe "Fitts:Susan Brown (1798-1844)" died August 30, 1844 in Denton Co., TX.  She married twice.  Shexe "Fitts:Susan Brown (1798-1844)" married Daniel B. Ripleyxe "Ripley:Daniel B. ( -dec.)" 1818.  Shexe "Fitts:Susan Brown (1798-1844)" married Edward Freeman Comegysxe "Comegys:Edward Freeman (1797-1875)" in Tuscaloosa, AL, 1834.  Edwardxe "Comegys:Edward Freeman (1797-1875)" was born in Kent Co., MD April 13, 1797.  Edwardxe "Comegys:Edward Freeman (1797-1875)" died January 10, 1875 in Courtlant, AL.  Edwardxe "Comegys:Edward Freeman (1797-1875)" served in the military in the Civil War.  In 1884, they went to Denton, TX and in 1891 to Gainsville, TX, where Professor Comegys was superintendent of public schools. Sarahxe "Duke:Sarah Sallie\" (ABT 1780-dec.)\"" was born in Bute Co., NC about 1780.  Sarah was the daughter of Green Dukexe "Duke:Green ( -BEF 1811)" and Mary Parhamxe "Parham:Mary ( -BEF 1810)".  There is no headstone for Sallie in the family plot at the Fitts homestead on Oakville Road; however, she is probably buried in this cemetery. Henry was a farmer, land owner and merchant. He and Benjamin Riggan were partners in Fitts & Riggan, Merchants. He was also a preacher in the Methodist Episcopal Church. He was a County Trustee from 1802-1808, named as guardian to at least ten minor children, State Senator in 1809. At his death he owned several tracts and a large number of slaves. The 1810 census shows him with 28 slaves and 7 looms. He was voted a member of the Court of Pleas and Quarter Sessions for many years and served as Chairman. He was a delegate to the National Democratic Convention in Baltimore in 1840 and served as a trustee of Randolph Macon College. (Warren Co. records) Henry was also known as a "doctor," though self-taught and his practice included his family and neighbors. His family home is located on Oakville Road, about four miles from Route 158 on the right-hand side (about 8 mi. north of Warrenton); the family cemetery is adjacent to the homestead, which was standing in 1999. 

Henry gave an acre of land and a church of logs was built in 1771. The earliest deed located is dated February 23, 1771. Now Hebron United Methodist Church, it is located seven miles east of Wise and the Wise Five Fork Road in Oakville. Mr. Fitts, in the course of his preaching, acquired the honored title of Reverend. With the help of Nathan Milam, John E. Twitty, John Boyd and other men of the community, built the church which is standing today. (hand-written history written for the first homecoming, most probably written by Mary Ann Twitty Palmer about 1890)

1800 census of Warren Co. NC shows Henry with 1M16-26, 1F16-26, 1F-10, and 10 slaves.

1807-1810 (Warren Deed Bk 18, p. 315) shows a deed from Henry Fitts to George Nickolson (d. 1818).

On November 11, 1807, Henry Fitts sold to John Ellis 100 acres...maple on a great branch at mouth of Spring Branch, Benjamin Bells line, Ransom Kimbels line, formerly Talley's, James Pains corner, Claiborns path, said Fitts received it from Joseph Hawkins, Sheriff; Wit: Thos. Beasley & Barnet Beasley. (Warren Co Deed Bk 18, p. 111) (Note: John Ellis was father of Charles Ellis & John H. Ellis in below 1816 deed)

Henry Fitts was a witness to the December 28, 1816 sale by Charles Ellis, now of Warren Co., KY, to his brother, John H. Ellis, his inheritance from John Ellis, Lot #7, adjacent Robinsons ferry road, Henry Fitts, James Colclough and Sampson King, 158 1/2A; Joseph Shearin and William Hicks were also witnesses. (Warren NC Deed Bk 23, p. 265). On April 6, 1819, John H. Ellis sold this land to James Colclough; Joseph Shearin and Henry Fitts were witnesses. (Warren NC Deed Bk 23, p. 262)

Henry was named as a legatee of Gideon Pegram in 1823, who left to Henry furniture and land after the death of his wife. John P. Nicholson (son of George d. 1818) was a witness to that will. George Pegram called Henry Fitts his "friend" and gave no family relationship.

A document dated January 22, 1827 shows Henry Fitts and George Casthorn of Warren County as Attornies in fact for Thomas B. Eaton in the sale of 12 slaves to George Anderson for $3,345.25. Slaves were Ruffin, Randol, Joshua, Stephen, Millie, Horrice, Henry, Francis, Betty, Lila, John. _ .

Deeds from Mecklenburg County, Virginia, show that Henry bought or owned land in that county as early as 1823. He sold or gave some of this land to sons Henry Green Fitts, James M. Fitts and Oliver Duke Fitts.

Henry Fitts, male age 40-50, with a female 30-40 and a male child under age 5. He is enumerated next door to Oliver Fitts in 1830 Mecklenburg Co., VA. He has slaves: 3M-10, 1M10-24, 6M24-36, 3M36-55, 1M55-100, 1M100+, 1F-10, 3F10-24, 2F24-36, 1F36-55. Henry, is not found in 1830 Warren County and this is probably him in Mecklenburg VA.

1840 census, Warren Co., NC (p.236) shows Henry Fitts 20-30, M60-70, F15-20, F20-30. Slaves: 13M-10, 4M10-24, 1M24-36, 7M36-55, 3M55-100, 11F-10, 7F10-24, 7F24-36, 4F36-55, 4F55-100.

From the Diary of John Early, Bishop of the Methodist Episcopal Church South, recorded between 1808-1812, and published in the Virginia Magazine of History & Biography, 34V312 and 36V176: Tues. 27th to Hebron 20 miles I preached...stayed at Brother Fitts, a very religious family. Wed. 28th to Zion 10 miles. Fri. July 3rd 1812 Roanoke Chapel...saw old friends from Caswell. Brother Fitts and myself stayed at old Mr. Robinsons. This "Brother Fitts" is most probably Henry Fitts d. 1847.

Will of Henry Fitts dated April 28, 1845, probate February Court 1847: Sons Oliver D. Fitts, Henry G. Fitts, James M. Fitts and sons-in-law Nathan Milam, Horace Palmer, Thos. T. Twitty, and Matthew M. Drake - all that portion of the land where I now live, adj. Colclough, the branch, Anderson F. Brame (my Spring Branch), William Brame, Patsy Hix, and Patsy Ellis, containing 500 acres, with all dwellings, ten Negroes, etc., to be held in trust for the use of my daughter Susan Twitty (wife of John E. Twitty) and her family, and this property shall not be liable for the debts of her husband, and it shall fall to her children at her death. Daughter Harriet Fitts - $200 to purchased furniture, also fifteen Negroes (unnamed), but if she should die without issue, the Negroes shall be divided between her sisters Polly Rogers, Winnefred Drake, Caroline Palmer, Eveline Twitty, and Elizabeth Milam. To my grandchildren Alice A. F. Scoggins and James H. Scoggins (children of my deceased daughter Ann Scoggins) - eight Negroes to hold in common stock and not to be divided until they are twenty-one, to be used for their joint support and education, but if both should die underage and without issue, these Negroes shall fall to the children of my daughter Susan.          Hexe "Fitts:James Harris (1796-1832)" married Rebecca Emily Alstonxe "Alston:Rebecca Emily (1797-1858)" in Warren Co., NC, June 30, 1814.  Rebeccaxe "Alston:Rebecca Emily (1797-1858)" was born in Warren Co., NC February 15, 1797.  Rebecca was the daughter of Samuel Alstonxe "Alston:Samuel (1770-1807)" and Elizabeth Faulconxe "Faulcon:Elizabeth ( -dec.)".  Rebeccaxe "Alston:Rebecca Emily (1797-1858)" died March 29, 1858 in Tuscaloosa, AL.  After her husband's death, Rebecca moved from Clarke County and settled on the plantation in Marengo County near Uniontown, with her son, Samuel. In 1836, she moved to Tuscaloosa, AL with her other children. Marriage license granted June 25, 1814, Warren Co., NC. (Brent H. Holocomb, "Marriages of Warren & Bute Cos.," 1991) They moved to Washington Co., AL, near Old St. Stephens, then later to Clarke Co., near Jackson. James was a member of the legislature of Alabama from Clarke County 1822-23. He bought 1,200 acres of land near Woodville (now Uniontown) AL, along with some smaller tracts in Marengo Co., AL. He was shot by a 'discharged superintendent' named Cabiness, who shot him through a window when he was sitting at the supper table. He was buried at Woodville/Uniontown in the cemetery which he had deeded to the town. His wife and several of his children are also buried there. He was buried near where he fell (near Smyrna) and later removed to Evergreen Cemetery at Tuscaloosa, AL.

Henry Fitts supposedly died at the age of 21; he drowned in the Tennessee River, Tuscaloosa, AL. Descendants of Alfred Fitts show that Alfred was the son of this Henry Fitts. Age 21 was relatively young to be married and have a child; Annette Smith has been unable to find a marriage license or other records to prove this relationship. (LDS Ancestral File submitted by J. H. Arnold, Newman, GA; researcher Annette Smith met at Gadsden library also showed the same) James Harris Fitts shows no date of death for Henry, nor did he publish any information on him except that he was born in 1800.

1850 Warrenton, Warren Co., NC (p.42): John E. Twitty, 50, farmer; Susan, 50; William E., 24; Mary 22; Sarah F., 19; Caroline M., 10; John E., 12. They are living next to Joshua Harris and that house away from Susan's brother, Oliver Fitts.

1850 Slave Schedule shows John E. Twitty, p. 789 or 792. J. E. Twitty is slaveholder on 1860 Slave Schedule, p. 54, and recorded on page following Henry Fitts, son of Oliver Duke Fitts, and next to H. E. Thrower.

A Joshua P. Twitty, age 26 in 1880, is living in the household of John's 2nd wife, Carolyn M. (Nicholson) Twitty, and she calls him grandson. His father is not known.

John E. Twitty is recorded in the history of Hebron Methodist Church as one of the men who helped build the church with Henry Fitts, Nathan Milam and John Boyd.                                "Sallie D. Twitty dressed in mourning and during the remainder of her life never wore anything but black, and never remarried. She dedicated her life to teaching: Warrenton Female College 1867-1869, of which she was a graduate; Mesdames Jones and Twitty's School 1869-1873; Governess in the family of Gov. Elias Carr; Wilson Collegiate Institute; and was Lady Principal of Oxford Female seminary (later Oxford College) for more than 25 years, retiring in 1915. She served as President of the Warren Co. Chapter, United Daughters of the Confederacy from 1916-1921. (Lewis Joel Gregory, The Twitty Family in America 1671-1976, 1976) 
                                      Johnxe "Twitty:John Eldridge, (Jr.) (1837-1864)" served in the military in in Civil War.  He was mortally wounded at the Battle of Spotsylvania Courthouse on May 12, 1864, he died nine days later at Carver Hospital, Washington, DC. He had a will which named his wife, Sallie Drake Twitty and brother, Henry F. Twitty. He is buried at the family cemetery on Oakville Road, Warren Co., NC.

Mathew was the son of Caswell Drake (Rev.)xe "Drake:Caswell, (Rev.) (1776-AFT 1851)".  Mathewxe "Drake:Mathew Mann (1798-1865)" died January 11, 1865 in Warren Co., NC.  Matthew was named guardian to George Collins Fitts.

                                      Johnxe "Drake:John Oliver (1837-AFT 1897)" served in the military in the Civil War.  He settled at Shocco Springs on land which he and his sister inherited from their uncle, Joseph. He was Justice of the Peace for many years at Warren County, living at Warrenton. 
         34.  Caroline3 Fitts (Henry2, Henry1) was born in Warren Co., NC December 13, 1803.  Carolinexe "Fitts:Caroline (1803-1846)" died September, 1846 in Warren Co., NC.  Shexe "Fitts:Caroline (1803-1846)" married Horace Palmerxe "Palmer:Horace (1801-1882)" in Warren Co., NC, May 24, 1838.  Horacexe "Palmer:Horace (1801-1882)" was born in Mecklenburg Co., VA October 12, 1801.  Horace was the son of Amasa Palmer (Dr.)xe "Palmer:Amasa, (Dr.) (1750-ABT 1827)" and Judith Micheaux Hendrickxe "Micheaux Hendrick:Judith (ABT 1780-dec.)".  Hexe "Palmer:Horace (1801-1882)" married Susan T. Russellxe "Russell:Susan T. ( -BEF 1838)" in Mecklenburg Co., VA, June 30, 1827.  Horacexe "Palmer:Horace (1801-1882)" died May 9, 1882 in Warren Co., NC.  It is not proved that Dr. Amasa Palmer was the father of Horace. 

Horace Palmer is recorded in the history of Hebron United Methodist Church as giving an acre of land for the church, adding to the acre given earlier by Henry Fitts. (hand-written history written for the first homecoming, most probably by Mary Ann Twitty Palmer about 1890)

There are several Chancery Court cases in Mecklenburg Co., VA, where Horace Palmer & Co. is shown as defendant.

1850 census, Warren Co., NC, p. 44. 1860 Merry Mount, Warren Co., NC (p. 290): H. Palmer, 59; R. Palmer (male) 26; W. Palmer (male), 15, all born in Mecklenburg Co., VA. 1860 Slave Schedule, p. 57 & p. 75; on page 75 are also N. Milam and W. C. Drake.

1880 Six Pound Dist., Warren Co., NC (p.18B), Horace Palmer, age 78, b. VA, is called father-in-law and living in home of Sophie F. Palmer.

In 1837, Horace Palmer posted bond for the marriage license of Henry Green Fitts & Lucy E. M. Davis, daughter of Ann. Horace didn't marry Henry Green Fitts' sister, Caroline, until 1838. It is not known when Horace's first wife, Susan Russell, died. The 1850 census of S. Dist., Halifax Co., VA shows a James E. M. Palmer b.c. 1814. The father of Horace Palmer is not proved and his siblings are, at this time, unknown. It is just a guess that Ann Davis may have been a sister of Horace Palmer and why he would have posted bond for his orphaned niece and that James E. M. Palmer is a brother, with the middle initials "E.M." having some family meaning and being used by Ann for her daughter, Lucy. IF Henry Green Fitts married Horace Palmer's niece in 1837, it would be logical that Horace Palmer would marry Henry's sister, Caroline, after his wife died.

NOTE: further research on this family may reveal inter-relationships with the Davis and Plummer families of Warren Co. NC and Mecklenburg Co., VA. There is most probably a relationship to the Palmers in Halifax Co., VA, which adjoins Mecklenburg County. Of interest, the given names "Amasa" and "Horace" are used for generations in an early Palmer family in Connecticut.

The relationship is not proved, but highly likely that there is a relationship between Horace Palmer and Benjamin R. Palmer b.c. 1832, who was living in Palmer Springs, Mecklenburg Co., VA in 1880, possibly uncle (Horace) and nephew (Benjamin). For purposes of this report, and until more information can be found, this relationship is being used so as to include the family of Rosa O. Palmer, daughter of Benjamin, as she marries into the Fitts family. Marriage bond May 19, 1938 Warren County posted by James O'K Mayfield, witness, Edward W. Best, Clerk.

Shexe "Fitts:Elizabeth (1805-1884)" married Nathan Milamxe "Milam:Nathan (1802-1870)" in Warren Co., NC, September 4, 1827.  Nathanxe "Milam:Nathan (1802-1870)" was born January 25, 1802.  Nathan was the son of John Milamxe "Milam:John ( -1816)" and Elizabeth Shortxe "Short:Elizabeth ( -dec.)".  Nathanxe "Milam:Nathan (1802-1870)" died October 16, 1870 in Greenbacks, NC.  He served as administrator for the estate of Dr. John P. Nicholson. He was guardian to his nephew, James Henry Fitts, son of Henry Green Fitts.

      36.  Oliver Duke3 Fitts (Henry2, Henry1) was born in Warren Co., NC October 3, 1807.  Oliverxe "Fitts:Oliver Duke (1807-1854)" died February 28, 1854 in Warren Co., NC.  His date of death taken from headstone at the Fitts family cemetery at the Henry Fitts homestead (now Perkinson farm) on Oakville Road in Warren Co.
         Hexe "Fitts:Oliver Duke (1807-1854)" married Harriet Elizabeth Ann Collinsxe "Collins:Harriet Elizabeth Ann (1810-1860)" in Warren Co., NC, April 15, 1828.  Harrietxe "Collins:Harriet Elizabeth Ann (1810-1860)" was born in Warren Co., NC February 8, 1810.  Harriet was the daughter of Michael Collins (Jr.)xe "Collins:Michael, (Jr.) (1778-1856)" and Elizabeth Drakexe "Drake:Elizabeth (1785-1820)".  Harrietxe "Collins:Harriet Elizabeth Ann (1810-1860)" died 1860 in Warren Co., NC.  1860 Slave Schedule, Warren Co., NC shows M. M. Drake Adm. H. E. Fitts. The assumption is that she was deceased by 1860 and Matthew Drake was administering her estate. Slaves held in her estate: Black females ages 80, 50, 16, 13, 14, 18, 35, 8, 3, 1; Black males ages 60, 60, 32, 24, 18, 51, 8, 6, 4, 1. 

Records of Estates for Warren Co., NC show guardianships and property distribution for her children: Nathan Milam was appointed guardian of Frank M. Fitts, Aug. Ct. 1860. Matthew M. Drake was appointed guardian of George C. Fitts, Aug. Ct. 1860. As the result of a petition for division of slaves. Negroes were divided into six equal shares among Henry Fitts, Olivia D. Fitts, the infant George C. Fitts with his guardian Matthew M. Drake, the infant Frank M. Fitts with his guardian Nathan Milam and to the infants Anna E. Fitts and Mary D. Fitts, with Henry Fitts their guardian, Nov. Ct. 1860. M. M. Drake was appointed guardian of Annie E. and Mary D. Fitts, Nov. Ct. 1862. William C. Drake and wife et al petitioned for a sale of slaves, Nov. Ct. 1863, Feb. Ct. 1864. Record notes the slaves in question were Ben, Sylvia, Lucy and Patsy, who were ordered to be sold and proceeds divided into 1/5 shares, with 1/5 allotted to Olivia D. Drake, wife of William C. Drake, 1/5 share to Francis M. Fitts, and the remaining incommon for George C., Annie E., and Mary D. Fitts, minors, Nov. Ct. 1863. The accounts of Henry Fitts, dec'd., as guardian of Annie and Mary Fitts were ordered to be examined, Nov. Ct., 1863. The accounts of M. M. Drake as guardian of A. E., Mary D. and G. D. Fitts were ordered to be examined, Feb. Ct. 1864, May Ct., 1864. William C. Drake was appointed guardian of Annie E., Mary D. and George C. Fitts, Feb. Ct. 1865. Guardian accounts ordered examined with William C. Drake, Nov. Ct. 1867.

Date of birth from notes of David Collins without cites or sources. 1798 administration of William Ellis shows Ellis' land bounded by O. (Oliver Duke) Fitts, Ephraim Ellis, Jno. Hicks, the Townes and Seth Perkerson.

The deed index for Mecklenburg Co., VA, shows Oliver D. was given or purchased land from his father in June, 1832. (Deed Book 27, p. 116) O.D. and Harriett E. Fitts purchased land in this county from William Hunt on December 16, 1850. (Deed Book 33, p. 375) Further research is needed to see how this land was disposed of after Oliver's death in 1854 and the film of these deeds transcribed in hope of further information.

An Oliver Fitts, age 20-30, with a female age 15-20, was enumerated in Mecklenburg County, VA in 1830. It is currently thought this is Oliver Duke Fitts and his wife Harriett, recorded in Virginia before the birth of their first child. Oliver had slaves in Virginia: 1M-10, 5M10-24, 2F-10, 3F10-24, 1F24-36, 1F36-55.

Next to Oliver is Henry Fitts, male age 40-50, with a female 30-40 and a male child under age 5. He has slaves: 3M-10, 1M10-24, 6M24-36, 3M36-55, 1M55-100, 1M100+, 1F-10, 3F10-24, 2F24-36, 1F36-55. Oliver's father, Henry, is not found in 1830 Warren County and this is probably him in Mecklenburg VA. Enumerated on the same page of the 1830 census is a Richard Fitts, age 50-60, with a female 70-80, and not too far away a John H. Fitts and a Robert N. Fitts. If or how any of these Fitts are related is not currently known. Robert Walker Fitts was the first Fitts shown in Mecklenburg by 1820, moving there from Halifax County sometime after 1810.

Warren County Deed Book 27, 1835-1840, p. 210: Know all men ... that I Benjamin Nicholson of Urban Nichols and by virtue of an order of the County of Warren, at Publick Sale, ..... I have this day sold to Oliver D Fitts, Negroes Mariah, Plummer William & child Jane, for the sum of twentysix Hundred and twenty dollars ..... as fully as I am authorized by Will ......this _ day of April 1837, Witness Henry G. Fitts. NOTE: From oral history from descendants of Mariah Fitts, her husband (Cohabitation papers give date of 1846), Benjamin Nicholson, went with one of the Fitts sons, probably Henry, during the Civil War and was set free for his service. The 1870 census shows Benjamin & Mariah Nicholson and her son, Larkin, living next to Frank Fitts. It would appear that Frank received Mariah and Larkin from the distribution of his mother's estate in 1860. (research of Alexs P. Turner, Jr.)

Oliver D. Fitts recorded the 1840 Warren census in a beautiful hand. Oliver is listed in Dist. 4, p. 236: M5-10, M30-40, F-5, F30-40. Slaves: 4M-10, 5M10-24, 4M24-36, 4F-10, 3F10-24, F24-36, F36-55, F55-100.

In 1847, a transfer of land from will of Henry Fitts, to O.D. Fitts, on October 6, for $1,565, Hawtree Creek to State Line, for 285 1/4 acres.

Oliver served one term in the North Carolina Legislature in 1842. (James Harris Fitts, Fitts Family, Ft. Orange Press, Tuscaloosa, AL)

1850 census, Warrenton, Warren Co., NC (p.42) shows Oliver D. Fitts, age 43, b. NC, farmer, property value 12,000; Harriet E. A., 40; Francis M., 9; Anna 6; Mary 3; and George, 1. Oliver is one house away from his brother-in-law, John E. Twitty and three houses from his brother-in-law, Mathew M. Drake. 1850 Slave Schedule shows Oliver D. Fitts: Black females ages 100, 65, 40, 15, 12, 7, 7, 5; Mulato females ages 40, 16, 10; Black males ages 45, 40, 42, 30, 25, 32, 20, 18, 12, 5, 6; Mulato male age 23. Oliver's son, Henry, may be the Henry Fitts, age 17, in the 1850 home of William Hooper, 57, a Baptist Minister, which appears to be a school arrangement.

         Oliver Duke Fittsxe "Fitts:Oliver Duke (1807-1854)" and Harriet Elizabeth Ann Collinsxe "Collins:Harriet Elizabeth Ann (1810-1860)" had the following children: 
            107         i. Elizabeth "Bettie Betsy"4 Fittsxe "Fitts:Elizabeth Bettie Betsy\" (1831-1831)\"" was born in Warren Co., NC May 3, 1831.  Elizabethxe "Fitts:Elizabeth Bettie Betsy\" (1831-1831)\"" died August 17, 1831 in Warren Co., NC. 
            108        ii. Henry Fittsxe "Fitts:Henry (1832-1862)" was born in Warren Co., NC October 27, 1832.  Henryxe "Fitts:Henry (1832-1862)" died November 13, 1862 in Staunton, VA.  This may be the Henry Fitts, age 17, in the 1850 home of 1850 census of Warren County with William Hooper, 57, a Baptist Minister; also in the household are 21 individuals, including 15 year old James H. Fitts, student, (son of Henry Green Fitts). This was probably a school arrangement. 
                               Henry was a Private, Company F, 12th Regiment, NC. He enlisted on April 18, 1861, as a 28 year old farmer. He was present and accounted for until hospitalized at Richmond, VA on June 28, 1862 with a gunshot wound. He was reported absent wounded or absent sick until he died at Staunton, VA of typhoid fever. 
                               This is probably the Henry Fitts enumerated in 1860, Warrenton Post Office, Warren Co., NC, age 26, farmer, real estate $2,000, personal estate $4,000, born in Warren Co. (p. 489) 1860 slave schedule shows H. Fitts, with Black female, age 18; Mulato females 50, 18, 12, 4, 3; and Mulato males 28, 22, 16, 12, 6. 
                               Henry was guardian for his two youngest sisters, Anna E. and Mary D., appointed August Court, 1860 (after the death of their mother). At November Court, 1863, William C. Drake and his wife petitioned the court for sale of slaves. February Court 1864 shows slaves, Ben, Sylvia, Lucy and Patsy were sold and proceeds divided into 1/5 shares allotted to Henry's siblings, and William C. Drake had become guardian to Annie E. and Mary D. Fitts, minors, who had been in the care of Henry. 
                               A family oral history (Alex P. Turner, Jr.) handed down by descendants of slaves on the Fitts homestead indicated that their ancestor, Benjamin Nicholson, went with one of the Fitts brothers during his Civil War service. That Fitts was wounded, hospitalized at Richmond and later died. Only two brothers served, Frank and Henry. Both were wounded, but Henry was hospitalized at Richmond and died in 1862. If this oral history holds, Benjamin Nicholson would have been with Henry Fitts and was supposedly set free in reward for his service to Henry during the war. Benjamin and his wife, Mariah, are found in 1870 living by Frank Fitts in Macon, Warren Co., as is their son, Larkin. Mariah was purchased by Oliver Duke Fitts from Benjamin Nicholson as part of the estate of Urbane Nicholson. It would appear from the 1870 census that Mariah and her son, Larkin, were part of the slave distribution to Frank Fitts after his mother's death in 1860.

After the death of her mother in 1860, she was appointed her older brother, Henry, as her guardian, along with her sister, Anna E. (Harriet). After Henry's death in 1862, William Caswell Drake was appointed her guardian. Drake had married her older sister, Olivea. 
                               She is living with Benjamin Collins, her mother's brother, in 1880 and 1900. The head of household in 1920 is Benjamin's son, Thomas, and Mary is shown as age 70 and cousin. She is in the household of Mary W. P. Collins (widow of Benjamin) in 1830 and shown as niece-in-law, age 81. 
                               Known as "Cousin Mary," she lived 'to be incredibly old and everyone who knew her loved her. for many years she was blind and had to be helped with everything she did. By some miracle that could not be explained, she regained her sight at a very old age. It was considered remarkable that she could read the newspaper without glasses. Minervaxe "Jones:Minerva Temperance (ABT 1816-BEF 1844)" was born about 1816.  Minerva was the daughter of William Duke Jonesxe "Jones:William Duke (1788-dec.)" and Mary Ann Speedxe "Speed:Mary Ann ( -1826)".  Minervaxe "Jones:Minerva Temperance (ABT 1816-BEF 1844)" died before 1844.  Hexe "Fitts:Henry Green (1811-1849)" married Lucy E. M. Davisxe "Davis:Lucy E. M. ( -dec.)" in Mecklenburg Co., VA, 1837.  Lucy was the daughter of Thomas Davisxe "Davis:Thomas ( -BEF 1808)" and Ann (Palmer or Plummer)xe "(Palmer):Ann ( -dec.)".  1850 census, Warren Co., NC, Warrenton, shows Lucy E. M. Fitts, 30, with Rosa 8, Sally D, 5, and James M. Fitts 4, children of her sister, Martha, who had married Henry's brother, James Fitts, d. 1846. Lucy married 2nd William T. Perry to Henry G. Fitts for $2,448, for six slaves: Boy Lewis, Man Ephrapen, Woman Hannah and three children. (May Court 1839, Bk 27, p. 450) 1840 deed from William Falkener to H. G. Fitts for $700, Negro woman Evernice. (Deed Bk 27, p. 541) NOTE: some of these names appear later in the account book of Henry's son, James. 1840 census of Warren Co. (p. 236) shows Henry G. on the same page as his father, Henry, and brother, Oliver D.: M-5, 3M20-30, F20-30. Slaves: 4M-10, 2M10-24, 4M24-36, M36-55, 4F-10, 4F10-24, 2F24-36, F36-55.

Thomas was the son of William Twitty (Sr.)xe "Twitty:William, (Sr.) (ABT 1762-1817)" and Anna "Nancy" S. Turnbullxe "Turnbull:Anna Nancy\" S. (1782-1853)\"".  Thomasxe "Twitty:Thomas Turnbull ( -1889)" died 1889 in Farmville, VA.  He was a wholesale tobacconist in New Orleans. Marriage license granted December 13, 1827, Warren Co., NC. (Brent H. A Lula Twitty, age 22, b. Louisiana, was called cousin and in the household of William H. & Alice Palmer in 1880, Six Pound Dist., Warren Co., NC. Lula is very likely a granddaughter of Thomas Turnbull Twitty, who was in Louisiana and the children of Thomas' sons are not known.

                               According to the history of Hebron Methodist Church, she established the first Sabbath School at the church. She had a "2-horse wagon driven all over the neighborhood some time going this way herself to convey children to the school who lived too far away to walk and had no other way of going. She taught them the catechism, read the Bible to them and in many instances taught them the alphabet and how to read."

                               A DAR submission by Louise Twitty Hobbs (DAR ID #120477) shows Louise Twitty born in Murfreesboro, NC, wife of Frank May Hobbs and a descendant of William Duke, as follows: James Fitts Twitty m. Annie Beamon, son of Thomas Turnbull Twitty & Eveline Fitts; Eveline Fitts the daughter of Henry Fitts & Sallie Duke; Sallie Duke daughter of William Duke and Mary Green; William Duke 1756 Brunswick VA-1845 Granville NC served several enlistments as a private under different commands in NC & VA, applying for a pension in 1832. Mrs. Hobbs descent is incorrect, as she missed a generation: Sallie Duke's father was Green Duke and the  William Duke who had Revolutionary service was Green's first cousin, the son of Samuel Duke who was brother of William Duke, Green's father.

         39.  James M. (Monroe)3 Fitts (Henry2, Henry1) was born in Warren Co., NC 1815.  Jamesxe "Fitts:James M. (Monroe) (1815-ABT 1846)" died about 1846 in Mecklenberg Co., VA.  
         Hexe "Fitts:James M. (Monroe) (1815-ABT 1846)" married Martha Ann Davisxe "Davis:Martha Ann ( -dec.)" about 1842.  Martha was the daughter of Thomas Davisxe "Davis:Thomas ( -BEF 1808)" and Ann (Palmer or Plummer)xe "(Palmer):Ann ( -dec.)".  Her mother, Ann Davis, named her and her sisters in her will: Lucy E. M. Fitts and son-in-law Henry G. Fitts, Mary (or Martha) Ann Davis and Minerva Hinton. Several deeds in Mecklenberg Co., VA can be found with James M. Fitts as grantee. In 1845 Henry Fitts Sr. is grantor; 1846 P. L. Hinton; 1846 H. G. (Henry Green) Fitts; 1872 & 1873 E. H. Plummer; 1848 John E. Jones. James is shown as grantor in 1843 with Henry Fitts Sr. as grantee; 1844 grantees are Henry G., Lucy E. et al. On February 27, 1848, James M. Fitts Estate is grantee, John E. Jones grantor. 

Will of James M. Fitts, 1846, Will Book 16, p. 255, Mecklenberg Co., VA. Appraisal and Estate Distribution, Will Book 16, p. 333, Will Book 17, p. 131, Will Book 17, p. 138. He named beloved brother Henry G. Fitts as executor and guardian to children: James M., Rose C. and Sally D. He named his "mother" or "brother" _ A. Fitts. It looks like James. Codicil dated March 4 (can't read year or the contents).

There are several court cases in Mecklenburg Co. VA in 1875 & 1876 vs. administrator of estate of James M. Fitts. Surnames include Hinton, Davis, White, Seymour, Jones, Plummer.

James Harris Fitts' book shows James died after 1897; however, the will book for Mecklenburg County shows his will recorded between 1843 and 1845 and the above deed shows James' estate in 1848. It would appear that James died before 1845 and his son, James M. Fitts, Jr. is probably the one who died in 1897.
