About Jeremy Brooke

Jeremy Brooke (1981 - 2014)

Brief overview:

Jeremy (32), was pinned down by four attackers, while one attacker shot him in the chest and face, during an armed robbery at the Nkanya Lodge in Elliotdale, EC, on 21st February 2014.

Jeremy, an adventurer and qualified dive master, was born and brought up in Durban with British parents who returned to the UK in 2011. He was on a diving holiday with four of his friends, Gregory De Valle, Stephen Francis Boscher, Bradley van Staden and Beila Cook, when five armed perpetrators broke into the lodge around midnight.

Jeremy leapt onto the back of one of the attackers in an attempt to protect his friends. They attempted to stop the bleeding, while Jeremy was still conscious, and he said, ‘tell everyone I love them’.

Neighbours helped get him onto a truck and drove for two hours to hospital, performing CPR, but he died before reaching it.

  • Trial/Conviction
    • After multiple delays, Jeremy's family waited six years to see justice done. But after what appeared to be a slam-dunk case, Judge Buyiswa Majiki found all five of the perpetrators not guilty of murder due to “conflicting evidence” as to who pulled the trigger that fired the two fatal bullets - the two versions presented by the state, hence the court was unable to reach a conclusion which of the accused discharged the fatal shot.
    • Where there is doubt it works to the benefit of the accused and the state must prove its case beyond reasonable doubt. Akhona Thornto, Malibongwe Lugalo, Yandisa Masimi and Mkhanyisi Qalingoma were found not guilty along with Sicelo Sigagayi who was killed in a gangland shoot out in 2017, but found guilty of robbery with aggravating circumstances and possession of stolen property, including the stolen car, and for possession of firearms. Court has been adjourned for sentencing until 29 January. Prosecutor Nomapha Mvanda is going to appeal the ruling and demand a retrial.
