I, Jesse Brashear, of the county of Rutherford and State of Tennessee, being of sound mind and memory, but of a declining state of health, and calling to mind the uncertainty of the body and knowing that itis appointed for all men once to die, do hereby make, ordain and constitute this my last will and testament, in manner, form and substance as followeth, to wit,.

Item 1st: I will and bequeath to my beloved wife Betsy Brashear during her widowhood or natural life all the use and profit of the plantation that I now live on, also one negro woman by the name of Cate, to do and dispose of her as she thinks proper at her death, but if said negro woman should have any children before the death of my said wife, at her death I wish said children equally divided between all my children share and share alike. I also give to my said wife one feather bed, bedstead and furniture belonging to the same, her choice of all in the house, also two sows and pigs, her choice of my stock, also two work horses with sufficiency of farming utensils to cultivate said farm, also two cows and calves, her choice of the stock, with all the kitchen and table furniture, also five head of sheep, also her side saddle and reading Bible, with a resonable allowance of provisions for the support of my said wife and family for the term of one year to be laidoff out of the stock of provisions on hand at my decease, and if my said widow should marry after my decease, the negro girl Caty her horseand saddle, bed and furniture and cow and calf I wish her to enjoy and dispose of as she may think proper, also with one sow and pigs, alsotwo ewes and lambs, and if she should marry I wish my plantation withthe residue of the property left to my said wife during her widowhoodimmediately at my said wife's marriage to fall into the hands of my executors, and them rent the same from year to year and the articles ofpersonal property to dispose of to the best advantage, and the proceeds of said rents, sales, plantation and I wish and direct my executorsto appropriate to the use of educating those of my children who have not received their education, but if all or the major part of my children at my said widow's marriage should have received their educations,then I leave it discretionary with my executors to approporiate so much of said rents and proceeds of sales aforesaid to the education of such of my children who may not at that time have received their education, so as to make them as good scholars as those already educated andthe balance of said rents and proceeds of sales aforesaid if any there should be, I wish and direct the same to be divided equally among all my children, share and share alike.2nd: I give and bequeath unto my beloved daughter Docia Bivens, one negro girl by the name of Bleary, with one black mare, saddle and bridle, which she has already in possession, also her bed and bedding, also two sows and pigs, two ewes and lambs, part of which she has now received and the residue is now ready to be delivered to her. 3rd: It is my will and desire that my three daughters, to wit, Rebecca Jarrett, Betsy Brashear and Polly Brashear, that they must be put on equal footing with my said daughter Docey Bivens out of my estate. I have already given Rebecca Jarratt one mare and colt worth thirtydollars more than the mare I gave Docey Bivens with her bed and furniture equal to said Docy. Also I have already given said Rebecca her saddle and bridle, two sows, two ewes and lambs, and whereas I have given my daughter Docey Bivens one table worth twelve dollars, a set of knives and forks worth two dollars and one trunk worth five dollars, I wish and direct that my said three daughters Rebecca Jarrett, Betsy Brashear, and Patsy Brashear be made equal in that as well as every otherrespect out of the proceeds of my estate--and whereas I have lent to my daughter Rebecca Jarratt one negro boy named Nelson, which boy I wish her to retain in possession until she is furnished with a negro girl equal to the girl which I gave to my daughter Docey and then said negro boy to return to my said estate and belong to my son Isaac W. Brashear, but is to be understood that the valuation of the said negro girl is to be considered equal at the time said girl is furnished to saidRebecca with the exception of any children born by said Docey Biven'ssaid negro girl, if any there should be. Item 4th: It is my will and I order that my negro boy Bob shall attend to the plantation and his mistress during her widowhood and no longer, but if my wife Betsy should remain a widow [more] than ten years from this date, I order that at the expiration of ten years from this date my negro boy Bob belong and be given to my son, Nathan Brashear, also it is my will that my negro boy Netran shall be given to my son, Isaac W. Brashears, and whereas there has been willed to my sons, Nathan and Isaac W. Brashear by their grandfather Isaac Wright, decd, the one half of a six hundred and forty acre tract of land lying on Tennessee River, Robertson Co., I will and bequeath the said land to saidNathan and Isaac W. Brashear, together with each of them to receive one horse, saddle and bridle at the age of twenty one years, said horse, saddle and bridle to be estimated at one hundred dollars each, also one cow and calf, one sow and pigs, one bed and furniture each, with good English learning.5: It is my will and desire that my two sons, Abraham and Jesse Brashears, shall have the tract of land whereon I now live to be equally divided between them according to quality and quantity when they arrive to the age of twenty one years, the beginning of said division I order to begin at in the centre of my spring in the bank of the river so that each may have equal privilege of said spring and river, southwardly for equal division, and I order and direct that my son, Abraham Brashear, have the eastern part of said land and Jesse Brashear to have the western part of said plantation, which will include the dwelling house, barn, orchard and improvements. Item. I also give to my son Abram Brashear one negro boy named George--. I also give to Jesse W. Brashear one negro boy by the name of Oston--.It is my will and I direct that my sons Abraham and Jesse have each ofthem one horse saddle and bridle, one sow and pigs, one cow and calf,one bed and furniture, all to be equal to said similar articles of property before willed to my sons Nathan and Isaac W. Brashear.And after all the foregoing legacies are satisfied and all my just debts paid, I order and direct that all the balance of my estate of everydescription be equally divided and share and share alike among all mychildren heretofore named. And lastly I order and request that my trusty friends, Guy Smith, Charles Ready, and John L. Jettow, be my executors of this my last will and testament, as witness my hand and seal this 25th day of August in the year of our Lord 1821,.
