Jane Byrd Claypool of Rockingham, VA is probably ~not~ a daughter of John Byrd of Surry VA and Chowan NC. There is no Jane listed in the will of John Byrd (although there is a reference to an unborn child). She is probably from the Byrd family of Rockingham, VA (unrelated to these Byrds).

This John Byrd is not connected with the Westover Byrds, not connected to Martin's Brandon, and not connected to Broxton, England.

There are no documents linking the families, and DNA has proven them to be unrelated. (In other words, he can not be the paternal grandson of William Byrd and Hannah Grendon. DNA has proven that this is impossible.)

The Westover Byrd male-line descendants (i.e., men named Byrd, Bird, etc.) are yDNA Haplogroup G (specifically, a very rare subclade: G2a3b1a2).

The male-line descendants of John Byrd and Rebecca Sutton (again, men named Byrd) are Haplogroup R1b. These two haplogroups are not even remotely related to each other.;wap2

There is, furthermore, no paper trail connecting the two families, so an adoption is out of the question.

It also seems unlikely that this man was a son of John Byrd/Burd who married Ann _____ and died in Surry County VA 1694. Although John Byrd 1670-1716 was alive in 1694, he was not mentioned in the will of John Byrd/Burd.

"In Surry County Virginia there is a nuncupative will [given orally, before witnesses] for John Burd dated 1694. It does not list wife or children. In his will, he leaves his estate to the people who took care of him in his old age." (letter from Rebecca Byrd, source: )

John Bird/Burd/Byrd Sr died April 1694 in Surry County Virginia, book 5 p. 19 Surry County Virginia Wills and administrations. This person is one possible father for John Byrd/Bayard d. 1716. Another possible father for John Byrd d. 1716 is Valentine Byrd d. abt 1680. Valentine's widow, Margaret, married as her second husband John Culpepper, a prominent Quaker from Albermarle.

In the name of God Amen the thirteenth day of September one thousand seven hundred and sixteenth I John Bayard of North Carolina and precinct of Chowan being very sick and weak in Body but of perfect mind and memory Thanks be unto God: Therefore Calling unto mind the Mortality of my Body and knowing that it is appointed for all men once to dye do make and ordain this my Last will and Testament that is to say principally and first of all I give and Recommend my Soul into the hands of God that gave it and my Body I Recommend to the Earth to be buried in decent Christian Burial at the discretion of my Exe nothing Doubting but at the general Resurrection I shall receive the same again by ye Mighty power of God. And as touching such wordly estate where with it hath pleased God to bless me in this life, I give demise and dispose of the same in the following manner and Form.

Will is apparently dated September 16, 1716 and probated October, 1716 in Chowan County, North Carolina.

The Executor was John Hardy, and the witnesses: John Crumbie, Susannah Williams, and Mary Damrell.

The book Byrd History and Related Families of ..., by Tera Byrd Averett, 1978, shows his birth date to be ca. 1675, and it states that John Byrd migrated from Virginia to Carolina before 1697 and served as judge of the Carolina Court of Admiralty of North Carolina
