About Joseph Hoxie

Joseph Hoxie50 was born on 1 May 1702 in Sandwich, Barnstable, Massachusetts Colony. He was christened on 1 May 1702 in Sandwich, Barnstable, Massachusetts Colony. He died in 1765/66 in Sandwich, Barnstable, Massachusetts Colony. Son of Gideon Hoxie and Grace (Gifford) Hoxie. In Joseph's will, proved 11 March 1766, he gave " to my son Clerk Hoxie all my lands and buildings Mill and Stream which I purchased of Judah Allin also one piece of salt meadow at Muset; to my son Barnabas my lands and housing that I purchased of Jonathan Nye & also one half of my woodland in the plains so ailed; to my son Cornelius all my other lands and meadows and housings." Joseph Hoxie married Mary Clark 16 Jan 1723/24, when his father gave him a part of his farm and he built a house nearly opposite his father's, which was occupied by him and his descendants until torn down in 1893.

Joseph Hoxie Last Will & Testament July 16, 1765

The sixteenth day of the seventh month called July anno Domini One thousand seven hundred and sixty five I Joseph hoxie of Sandwich in the county of Barnstable in the Province of the Massachusetts Bay in Newgland human being of sound mind and Memory but under decay of body Do make this my last will and Testament and first I recommend my soul into the hands of God hoping for mercy and acceptance through Jesus Christ his only son, and my body to be buried in a decent manner at the discretion of my Executor hereafter named and as to my worldly Estate I give, devise and dispose of it as follows,

Imprimis; my Will is that my just debts and funeral charges and charges of Settling my Estate shall all (except what is due to my son Cornelius Hoxie upon a bond from under my hand and seal) be paid out of my live stock by my executor, and his bond to be paid out of what Estate I shall in this my will give and bequeath to my said Son Cornelius and his heirs and assign forever. ----

Item; I give and bequeath to Mary my loving wife (in lieu of Do___________) the Improvement of __ my real estate in Sandwich excepting one third of what I shall in this my Will give to my Son Cornelius Hoxie and his heirs and assign forever, all the rest I give her the use of so long as she remains my widow and no longer: I also give my said wife the Improvement of one half of my household Goods during her natural Life, and the Improvement of the other half of the said household goods, until my daughter Mary Hoxie is twenty four years of age or married that which first happen, said household goods is not to include my looms and tackling & Stays and Worsted Combs, Gun & mans saddle although my said Wife is to Improve the looms & tacking and Worsted Combs so long as she remains my widow: I also give to my said Wife one half of my live stock that is left after my Just Debts and all charges as above mentioned are paid and one cow took out for my Daughter Mary, one half the remainder I Give her to her own dispose, I also give my said Wife in case she marry again four Pounds Lawful money to be paid by my son Cornelius Hoxie in one year after marriage.

Item; I give and bequeath to my son Clark Hoxie to him and to his heirs and assign forever all my lands and buildings, mill and stream which I purchased of Judah Atkin also one piece or parcel of salt meadow all Muset so called adjoining to the old harbor which I bought of John Freeman as Administrator to the estate of James Gifford deceased in like manner I give my said son Clark my Worsted Combs and all my Stays, and to come into possession of the above Real and personal at his mothers decease or marriage.

Item; I Give and bequeath to my son Barnabas Hoxie to him & his heirs and assign forever all my land & housing which I purchased of Jonathan Nye and also one half of my woodland in the plains so called in like manner I give him all my common Right in with the proprietor of the town and to come into possession at his mothers decease or marriage.

Item; I Give and bequeath to my daughter Mary Hoxie Twenty pounds lawful money to be paid by my son Cornelius when she is twenty four years old, or at marriage day that which first happens, I also give her One Cow and one half of my household goods at the same time as the money is due or will be due to her, and I also give to her the other half of my household goods after her mother term is Expired, at the above I give to my Daughter Mary or her heirs or those that shall Represent her begotten of her body. I also give my said Daughter Mary the Privilege to live in my house or to have a room therein so long; as she lives Single after her mothers decease or marriage.-----

Item; I Give and bequeath my gun to my Grandson Joseph Hoxie. --- Item; I Give and bequeath to my Son Cornelius Hoxie to him & to his heirs and assign forever all my lands & meadows, housing and every Individual of my Real Estate of what kind so ever in the Township of Sandwich. Excepting what I have disposed of before in this my will. In like manner I give him all my husbandry, tackling and mans saddle and looms and all the tackling except the stays I also give him one half of my live stock that is left after the Debts and all charges are paid as above mentioned and the cow took out for my daughter Mary. I also give my said son Cornelius all my personal estate not heretofore Willed and finally disposed of in this my Will and to come into possession of one third of the Real Estate and Saddle and husbandry tackling and his part of Live Stock at my decease and the rest after his mothers Decease or marriage all the above I give to my son Cornelius and his heirs & assign forever he or they paying what I have ordered him to pay my wife in case she marry again and what I have ordered him to pay my Daughter Mary and also paying the bond he has against me out of what estate I have given him ________ ______ ________ ________ Finally I do constitute and appoint my son Cornelius Hoxie Sole Executor of this my last Will and Testament in Will.
