Her Last Will and Testament

Katharine Arneill here treated made her last will and testament at Glasgow on 15 December 1610. She nominated her husband to be her sole executor. She left one hundred merks to John Gilhagie, to be paid to him after the death of her husband, and one hundred merks to her sister's sons, George and Thomas Louk, to be divided equally between them. Among the debts "awand by the deid" was one hundred and nineteen pounds which was due to her husband's brother James Gilhagie: "Item to James Gilhagie his brother ane hundreth nyntine pundis". Confirmation was granted to her widowed husband on 15 February 1611. Her free gear was divided into two parts, from which circumstance it would appear that Ninian Gilhagie and Katharine Arneill did not have any children, none at least who were still in life on 15 April 1611, the date upon which confirmation was granted to her widowed husband. James Gilhagie of Kendiehill, presumably the brother previously referred to, acted himself as cautioner for Ninian. [National Archives of Scotland, H. M. No record of any children has been found for Ninian Gilhagie and his wife Katherine Arneill. Katherine's testament testamentar makes no mention of any, and the fact that her free gear was divided into two parts, rather than three, confirms that there were no children. All the above mentioned bogus pedigrees, without explanation or justification, identify Katharine Arneill as Catherine Arneill. All of them misidentify her as the mother of a child named Ninian Gilhagie. Two of them identify her year of birth as 1565 and one as 1590. All three misidentify the date of her death as 15 April 1611.
