Francis McKimmy of Loudoun Co. died intestate leaving children Mary, Priscilla, Sarah, Wayne, Catherine and John, and his widow Elizabeth.
Catherine and John are infants (under 21 years of age) and the plaintiffsf have no way of partitioning about 120 acres of land in Loudoun County left by Francies McKimmy. Therefore they want the guardian for Catherine and John to agree to divide the land among Francis McKimmy's children, after giving dower right to Elizabeth.
E. Hammett as guardian ad litem to the two minor children answered the complaint and agreed to partition of the land. The court then orders John Grubb, Thomas White and Robert Moffett to divide the land equally (taking into account the quantity and quality of the land) among the descendants after providing Elizabeth with her dower.
