Ruth Smith
James Smith, Caleb Smith, Abrahm. Smith & Ephraim Smith Exrs. of ye last Will & Testamt. of Mrs. Ruth Smith late of Milford decd., Exhibited sd. Instrumt. in this Court, one of ye Witnesses to which being sworn before Nathan Baldwin Esqr. & one other in Court, the same is accepted as proved in Court & approvd. for Record. sd. Exrs. accept sd. Trust.
In the Name of God Amen I Ruth Smith of Milford in the County of New Haven in his Majsties. Colony of Connecticut in New England wife of Mr. John Smith, Daughter of Mr. James Brisco late of sd. Milford decd., having an Inheritance by Descent, belonging to me, being favoured with a sound mind & memory, through the favour of a good Providence to me ward, do make my last Will & Testament as followeth. Vizt: first of all I recommend my Soul, my more principal part, to ye mercy of a gracious God, throh: the Merits of our Lord Jesus Christ, by whom I hope for everlasting Life, & that after my Decease, my Body shall a decent Burial at the Discretion of my Exrs., if I dye in the State of widowhood and if I owe any thing ad my Decease in Right or Conscience to any manner of person or persons, that shall be first paid by my Exrs. with funeral charges; and as for my worldly Inheritance wherewith I am blessed, I dispose of the same as follows --- Item. I give unto my son James Smith, to him, his Heirs & assigns for ever upon the Condition yt he pay or cause to be paid to & among my natural Daughters equally, the sum of fifty pounds between all of them equivalent to money of our former Tenor / one fourth part of my Land, lying at a place commonly called the Point, with a fourth part of all my other Land & Rights in Lands wherever & whatsoever, divided and undivided.
Item. I give unto my son Caleb Smith, to him, his Heirs & assigns forever upon the condition that he pay or cause to be paid to & among my natural Daughters equally, the sum of fifty pounds, between them all, equivalent to money, of our former Tenor / one fourth part of all my Lands lying at a place commonly called the Point, with a fourth part of all my other Lands & right in lands, wherever and whatsoever, divided or undivided.
Item. I give unto my son Abraham Smith, to him, his Heirs & assigns forever upon the condition that he pay or cause to be paid to & among my natural Daughters equally, the sum of fifty pounds, between them all, equivalent to money, of our former Tenor / one fourth part of all my Lands lying at a place commonly called the Point, with a fourth part of all my other Lands & right in lands, wherever and whatsoever, divided or undivided.
Item. I give unto my son Ephraim Smith, to him, his Heirs & assigns forever upon the condition that he pay or cause to be paid to & among my natural Daughters equally, the sum of fifty pounds, between them all, equivalent to money, of our former Tenor / one fourth part of all my Lands lying at a place commonly called the Point, with a fourth part of all my other Lands & right in lands, wherever and whatsoever, divided or undivided.
Item. My Will also is & I give each & every Legacy, by m e willed, so yt if either of my said Children, to whom I have willed any legacy, be by divine Providence taken out of the world, by Death, before such child have received ye portion by me willed to them, such Child's portion shall, if any surviving lawfull heir be left of ye so deceasing, then that which otherwise should have been ye parent, shall be the legacy of the child or children, so left be they male or female & if any of my said children should be removed by Death & leave no natural heir by Descent, then my Will is, yt ye part otherwise to have been if Decds. part, I give equally between all my natural children; My [will] also farther is that ye before mentioned Legacies & Bequests, to be paid by my said sons, shall be paid within the space of two full years, next after my sd. sons inherit their parts.
Item. My Will also further is & I do hereby Constitute, ordain, make & appoint my four sons, James Smith, Caleb Smith, Abraham Smith & Ephraim Smith Exrs. of this my last Will & Testament, hereby making null & void any & all other Will or Wills at any time already by me heretofore made, ratifying this & no other as & for my last Will & Testament, therefore do, with the consent of my Husband, Mr. John Smith, set to my hand & Seal this 21st day of Janry.
