If the recipient died before his wife, the wife did not have heir rights. WILL of SAMUEL BRASSHEAR Maryland Hall of Records, Wills, L. 22, ff. 230-232: :: IN THE NAME OF GOD, AMEN. I, Samuel Brasshear, of Prince Georges Co., in the Province of Maryland, being of sound and perfect mind and memory --- Praise, therefore, be given to Almighty God --- I do made and ordain this my present last will and testament in manner and form, as followeth; first and principally, I commend my soul into the hands of Almighty God who gave it me, hoping through the merits, death and passion of my Savior, Jesus Christ, to obtain full and free pardon and forgiveness of all my sins and to inherit everlasting life; and my body I comit to the earth to be buried at the discretion of my beloved sons, Samuel Brasshear, John Brasshear, Robert Brasshear, William Brasshear, Bazell Brashear & Otho Brasshear, whom I appoint jointly & severally to be executors of my whole estate and to such wordly estate it hath pleased God to Bestow upon me. I give and bequeath thereof as followeth: :: Imprimis, I give and bequeath unto my wellbeloved son, Samuel Brasshear, all the right and title that I have to a bond due from john Prather, son of Catharine Prather, being part of a tract of land called the Orphans Gift, containing one hundred and fifty acres, to him and his heirs for ever. ::Item. I give and bequeath unto my wellbeloved son, Bazell Brasshear, all the right I have to a bond due from Aron Prather, being a part of atract of land called the Orphans Gift, containing one hundred and fifty acres, and likewise fifty acres joyning thereto, lying in a tract of land called Saint Andrews, according to the tenor of the said bond, to him & his heirs for ever. ::Item. Samuel Brashear Sr, (Back #11), The Maryland Carpenter, son of Robert Brashier, the Improvident, (Back #2), was born c1673, very probably in Calvert Co., MD. Samuel died between June 1, 1740 (date of will) and August 27, 1740 (opening of probate), in PGCo, MD. On 3 Oct 1724, Samuel Breshear swore, in an affidavit concerning the boundaries of "Orphans' Gift," that he was 51 years old, i.e. b. bef 3 Oct 1673 (PGCo Deeds, Bk M (old series 8), p.596). Probably about 1794, he married Ann Jones, daughter of William Jones and his wife Dorothy (ne Cager). Ann Jones was sister of Mary Jones, who m. Benjamin Brashear Sr (Back #10), Samuel's brother. The two family groups were, therefore, "double first cousins": their fathers were brothers and their mothers were sisters. In a family already prone to using the same names over and over again, the close ties thus created produced even more confusions, especially with the given names John and William.

Ancestral Note

In Generation No. 3, ["Descendants of Benois Benjamin Brashear," WorldFamily Tree CD, vol. 6, submitted by Chris Haynes] gives the first child of Samuel Brashear Sr and Ann Jones as Basil Brashear, b. c1692. This is an error that started in "The Balls of Fairfax and Stafford Co,VA," but seems to be immortal; it has outlived many a documented list. It is true that Samuel and Ann had a child named Basil (his birth was registered as 18 Mar 1714, in St. Barnabas Church, Queen Anne's Parish, Prince George's Co, MD). Basil m. Ann Belt, went broke, moved to Orange Co, NC, where he went broke again, moved to Spartanburg Co, SC, where he went broke a third time. He was certainly not the oldest child, who was named (as was the custom then) for his maternal grandfather, William Jones. ::Here is a corrected list of the children of Samuel Brashear Sr and AnnJones: (See "The First 200 Years of Brashear(s) in America," p. 103; references: Will of Samuel Brashear; births registered in Queen Anne Parish, MD Historical Society, Baltimore; Maryland Historical Magazine,v.23, p.113.) ::281. 51. Published research regarding Samuel's mother

There is question as to the mother of Samuel Brashears. I believe thefollowing excerpt will shed light on that question. The following excerpt comes from the published work, "A Brashear(s) Family History, Vol. 1 - The First 200 Years of Brashear(s) in America" by Charles Brashear and Shirley Brasher McCoy, Published August 31, 1998 by Charles Brashear. I have obtained a copy of this difficult-to-find work, and have scanned it in for easy searching and reference, and am happy to share with anyone who requests it - Gwendy Darling.

From pages 8-9: ____________________________________________ ROBERT BRASSEUR's FAMILYLETT ME EMPHASIZE, EVEN SHOUT: Robert Brasseur's wife is unknown.Many researchers give him an Elizabeth or Florence Fowke, but I'm convincedboth of those are errors. Florence ?Rey was wife of his son, Robert 11. Elizabeth Fowke was second wife of a Zachariah Brazier in VA in 1759, a centuiy and a half later. So far as I know, there is NO DOCUMENT in existence with Robert Brasseur's wife's name on it. In England (and much of Europe), it was the practice for a new resident upon arrival in a new place of residence to enroll his family in the parish registry in order to get permission to reside in the county. It was a sort of Census.The late Danny Brashear of Zilla, WA, claimed to have found such a parishrecord for Robert Brashear in Isle of Thanet parish, Kent Co, England.About1950, he submitted family sheets to the Family History Library (FHL) in SaltLake City (SLC), showing that the births of five of Robert's children wereregistered in Kent, including a Robert Brasseur Jr. Robert Brasseur Sr.'s wifeand the registered mother of the five children in Kent Co, England, was"Elizabeth Fowke." Zachariah Brazier to Elizabeth Fowke, which took place about 125 years later. Zachariah was identified as a son of Robert Brazier, of Kent Co, England.Zachariah Brazier, b. 1715, in Virginia, d. 1797, s/o Robert Brazier ofKent Co, ENGLAND; m. 1. 7 Apr 1740, (License, St. Phillip's Church, Charleston, SC) Mary Ann Fairfax, (South Carolina Marriages, 1688-1799, comp. Brent H. Additionally, from pages 78: ____________________________________________Robert married, second, Alice, widow of Thomas Jackson, about 1679, when she renounced her right to administer the estate of her deceasedhusband, Thomas Jackson. Some researchers have thought she was possiblythe daughter of Thomas Sprigg, but the Sprigg genealogy does not document an Alice at this time. (See "Sprigg Family" in "Related Families.")Back reports: "There seems to be adequate reason to assume that Alicewas Robert's second wife, and that she very probably was not the mother of all his children. Since it is almost certain that she renounced her administration of her late husband's estate not long after Thomas Jackson died [and she had remarried], it seems she could not have been the mother of two of Robert's sons, Benjamin and Samuel, who by their own statements, were bom in 1666 and 1673, respectively. On the other hand, it appears that Alice was the mother of Robert's son, Robert Jr,(i.e Robert IV) who, by his statement, was born 1686" (Back, p. 17). I think this statement of birth-year is very suspect. His age is citedvariously in the land records of PGCo, but most often as 1675-76. ____________________________________________

And lastly, from pages 88-91: ____________________________________________ ASSOCIATED FAMILIES: SPRIGGTroy Back (and many others) have thought that Robert Brashier, Ill'ssecond wife was Alice Sprigg; however, 1 seriously doubt that possibility. There is no documented Alice Sprigg in the Sprigg genealogy.Much of what follows is from an article, "Sprigg Family," by Christopher j Johnston, "Maryland Genealogies" from MD. Hist. Mag, v.2, p.387-397 j(summarized by Shirley McCoy in 1981 and integrated with material which J Charlie Brashear took from the Internet in 1996.) Thomas Sprigg Jr, the ancestor of the family in America, was bom in 1630, probably in Northamptonshire, England, and died in 1704, Prince Georges Co, MD. In a deposition made in 1665, "Mr. Thomas Sprigge" gives hisage as 35 years (Provincial Court, Bk FF, p.91), and in another deposition made in 1694, his age is given as 64 (Provincial Court, Bk WRC#1, p.696). His will was dated 9 May 1704, probate 29 Dec 1704 (Prince Georges Co, MD, Will Bk 1, p.23).Thomas Sprigg appears as a party to a suit in Provincial Court, Oct 1657(Archives of MD, v. 10, p.546). On 18 Jan 1658, he received a 600 acretractcalled "Sprigley" on Chester River, for transporting 'himself, Catherine, his wife, Verlinda Roper, Edward Busbell. Nathaniel Sprigge, and Hugh Johnson" (Land Office, "Tom Book" [What's that reference supposed to mean, Mr. Johnston?]). Was Nathaniel Sprigg a brother? or a first-born son? Any further records, anyone?Thomas Sprigg Jr probably came from Northamptonshire, England, about 1655, and took up tracts in Msiryland called "Kettering" and "Northampton, according to George L.L. Davis, in his book. Day Star of American Freedom, p.265. The records of the Maryland Land office show thathe lived on or near "Resurrection Manor," in Calvert County, in an area later included in Prince George's County.Thomas Sprigg Jr was one of the Justices of Calvert County and oftheQuomm, in 1658, 1661, 1667, 1669-70, and 1674 (Archives of Maryland, v.3,p.424; V.14, p.61; v.l5, p.37; Bk S, p.54; Bk CD, p.412). In 1661, hisnamestands at the head of a Commission, showing that he was Presiding Justice ofthe County (Archives, v.3, p.424). On 17 Aug 1661, Thomas Sprigg of "ResurrectionManor" and wife, Catherine, conveyed 600 acres in Worrell Hundred, Talbot Co, MD, to Simon Carpenter (Prov. Ct, Bk BB, p. 176). Mrs. Catherine Sprigg may have been a sister of Gov. William Stone, or Gov. Stone may have married a sister of Thomas Sprigg, for in his will dated 3 Dec 1659, probate 21 Dec 1660 (Annapolis, Bk 1, p.89), Gov. Stone mentions "my brother Sprigg"; and Thomas Stone, son of the govemor, executedan assignment, 3 Aug 1662, of his right to 100 acres of land to "my uncle Thos Sprigg" (Land Ofc, Bk 5, p. 182). Mrs. Catherine Sprigg seems to have died without issue (says Mr. Johnston, I question this!) andbefore 1668.About 1668, Thomas Sprigg Jr m.2. Eleanor Nuthall, d/o John Nuthall.In Sep 1668, the Council of Maryland passed an order dividing the estate ofJohn Nuthall, deceased, among his three children, John Nuthall [Jr], JamesNuthall, and Eleanor (nee Nuthall), wife of Thos Sprigg (Archives, v.5, p.34).On 2 Jul 1696, Thomas Sprigg and Eleanor, his wife, conveyed 250 acresin "Resurrection Manor" to John Nuthall [Jr], of St. Mary's Co, MD, said landpurchased by Thos Sprigg from Capt. Thos Comwallis; John and Elias Spriggwitnessed the deed (Prov. Ct, BK WRC#1, p.760, 771). John and Elias arebelieved to be sons of Thomals Sprigg. Eleanor Sprigg, d/o Thomas Sprigg, m.2. John Nuthall Jr. On 16 Mar 1700/01, Thomas Sprigg of Prince Georges Co, MD, Gent,conveyed certain lands (parts of "Kettering," "Northampton," etc) to eldestdaughter, Sarah Pearce, his grandson John Pearce, only son of said Sarah, and Sarah, wife of John Bell, dau of said Sarah Pearce, a gift of lands lately in the tenure and occupation of John Sprigg, deceased (PGCo, Bk A, p.362). Since wife, Eleanor, did not participate in this dead, she was probably dead. Note that the will does not mention a Nathaniel Sprigg, who wastransported by Thomas Sprigg; they were probably brothers. Nor is there amention of an Alice Sprigg, who could have married first, Thomas Jackson, and second, Robert Brashier III. Since Thomas Sprigg mentions his othergrandchildren, I would expect him to mention any Brashear children that Alice was mother to. If b. cl660, she could be the 19-yr-old widow of Thomas Jackson by 1679, when she renounced her right to administer hisestate and married Robert Brashier, III. If she were dead before 1704,she might not be mentioned in the will of Thomas Sprigg. However, since Thomas Sprigg mentioned other grandchildren in deeds and his will, 1 would expect to see some mention of Robert Brashier IV, supposedly b.1686, s/o Robert Brashier, III and Alice ?Sprigg, somewhere. However, ifRobert Brashier IV were NOT a son of Alice, but Robert. Ill's first wife, AliceSprigg could have NO heirs and therefore just be dropped from all mention. Give me a document with names on it!!! ____________________________________________ With this information in mind, I propose we remove both Elizabeth Fowke and Alice Spriggs as Samuel's mother, but keep Alice Spriggs as Robert's wife.
