About Sir Thomas de Burgh, of Burgh Greene

Sir Thomas was the 2nd son. He inherited the estates when his elder brother John renounced the world and entered a monastery (where he died not long afterwards, leaving no issue)

There is a question mark over the paternity of the two brothers. Their father's sister Elizabeth Mountford sued, claiming that her brother was impotent, and therefore, Lucy's children must have been fathered by somebody else.

The case was settled out of court. Elizabeth renounced her allegation, but she walked away with Hackforth, which had been the main residence of the Burghs in the north, but was Mountford property from then on.

Obviously the renunciation was an essential condition of the settlement, to ensure that the claim couldn't be revived later. So it can't be assumed that the original allegation was necessarily false.
