Accident No. 9. — January 13th. An inquest was held over the remains of Stephen Lustig, on the 13th day of January, 1899, before Justice Fisher.

Bazilo Benirino testified as follows: "I was working with the deceased this morning at the 38th level south of No. 6th shaft, Hecla Mine. We were pinching down the loose rock when Captain Tonkin came into the slope and asked how things looked. We said, 'all right', then Lustig, the deceased, went ahead into the slope with a light to show Captain Tonkin around. I was about 20 feet behind when the rock fell on deceased."

John Pitiker, being duly sworn, testified: "I work in the Calumet and Hecla Mine. Was working this morning at the 38th level south of No. 6 shaft, along with deceased, who was my partner. We were pinching down the loose rock when Captain Tonkin came and asked us how things looked. We said. 'all right!' Captain Tonkin asked us how far we had to go, and deceased went in ahead to show him. They looked around and were just turning to come out, when a piece of vein rock, weighing about a ton fell on the deceased."

Captain Tonkin testified as follows: "Stephen Lustig and John Pitiker were partners together, stoping north and another party stoping south toward each other. The ground had been blasted and the deceased and John Pitiker were pinching down the loose rocks when I came around to see them. I told them to quit and do no more blasting. I then went down to the level, then went up into the stope again, where they were working, and asked how things looked and they said, 'all right!' We then went in to examine and see if there was any need of more blasting. The deceased went ahead and I was close behind. I said to him, 'don't do any more blasting!' and turned to go away, but had not gone but two or three steps when a piece of vein rock fell on Lustig."

The jury rendered the following verdict: "Stephen Lustig came to his death, accidentally, by a piece of vein rock falling on him while at work at the 38th level south of No. 6 shaft, of the Calumet and Hecla Mine, on the 13th day of January, 1899."

Onnettomuus nro. 9. — 13. tammikuuta. Kuolinsyyntutkinta tehtiin vainajalle Stephen Lustig, Tammikuun 13. päivänä 1899, johtajana tuomari Fisher.

Bazilo Benirino todisti seuraavasti: "Työskentelin hänen kanssaan tänä aamuna 38:lla tasolla etelään kuilusta nro 6, Hecla Mine -kaivoksessa. Olimme pudottelemassa irtonaisia lohkareita kun kapteeni Tonkin tuli louhospinnalle ja kysyi miltä näyttää. Sanoimme 'all right', ja sitten Lustig, joka kuoli, meni edellä leikkaukseen näyttääkseen valoa kapteeni Tonkinille. Olin itse noin 20 jalkaa (6 m) perässä kun lohjare putosi."

John Pitiker, vannottuaan todistajanvalan, todisti: "Työskentelen Calumet and Hecla -kaivoksessa. Olin tänä aamuna töissä 38:lla tasolla etelään kuilusta nro 6, yhdessä [Lustigin] kanssa, hän oli työparini. Olimme kangilla pudottamassa irtonaisia kiviä, kun kapteeni Tonkin tuli kysymään miltä paikalla näyttää. Me sanoimme 'all right!'. Kapteeni Tonkin kysyi kuinka pitkälle meidän pitää mennä, ja [Lustig] meni edellä näyttääkseen paikan. He katselivat ympärilleen ja olivat juuri palaamassa takaisin kun noin tonnin painoinen pala malmisuonta putosi [Lustigin] päälle."

Kapteeni Tonkin todisti seuraavaa: "Stephen Lustig ja John Pitiker oliva työparina, were partners together, menossa kohti pohjoista, ja siellä oli toinen ryhmä menossa kohti etelää, toisiaan kohden. Kallio oli räjäytetty, ja vainaja ja John Pitiker olivat pudottelemassa alas irtonaisia lohkareita, kun tulin paikalle heidän työtään katsomaan. Käskin keskeyttämään työn eikä jatkaa enää räjäytyksiä, Sitten menin alas tasolle, ja sitten nourin takaisin rintaukselle jossa miehet oliva työssä ja kysyin miltä paikka näyttää, ja he vastasivat 'all right!'. Sutten menimme tutkimaan paikkaa tarkemmin, joska olisi ollut tarvetta räjäyttää lisää. [Lustig] meni edellä ja minä seurasin heti perässä. Sanoin hänelle 'älkää räjäyttäkö enempää!', ja käännyin lähteäkseni pois mutten päässyt kuin pari kolme askelta, kun pala malmisuonta putosi Lustigin päälle."

Tutkintalautakunta päätyi seuraavaan ratkaisuun: "Stephen Lustig sai surmansa tapaturmaisesti malmisuonilohjareen pudottua hänen päälleen, hänen työskennellessään tasolla 38 etelään kuilusta nro 6 Calumet and Hecla -kaivoksessa 13. tammikuuta 1899."
