Birmingham, AL - The body of Judge Thomas C. McClellan, former Justice of the Supreme Court of Alabama, who died Sunday was to be carried to Athens, his former home, for burial today following funeral services here.
Judge McClellan died after waging a six months battle against ill health. He had been in declining health for several months and last winter submitted to an operation which failed to bring about a favorable change in his condition.
As a Justice of the Supreme Court from 1906 to 1923, Judge McClellan was said to have been the youngest justice to sit on the bench of the highest tribunal in Alabama. He was 56 years old at the time of his death. Judge McClellan retired voluntarily from the Supreme Court bench to become attorney for the State Docks Commission and to enter private practice. He served as attorney for the Docks Commission during construction of the new docks at Mobile and was representative for a number of corporations.
Surviving are the widow, Mrs. Sue Ruth McClellan, and one daughter, Mrs. Robert T. Ballentine of New York City.
