About Thomas Phillips, Sr.

Loudon County, Virginia, Book A, page 155 In the name of God Amen. The seventh day of October in the year of our Lord 1766 I Thomas Phillip Senior of Virginia Colony in Loudon county being very sick and weak in body but of perfect mind and memory thanks be given unto God therefore calling to mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my Last Will and Testament… Item I give to my well beloved sons

whome I likewise constitute make and ordain my only sole Heirs and Executors and my brother Jenkin Phillips a Executor with my sons Jenkin and Thomas Phillips whome I make my whole Sole Heirs both of Lands and Estate to them and their Heires and asines forever of this my Last Will and Testament all and singular the Lands Messuages and Tenements to them their heires and assigns forever equally divided between them my two Sons and as for any other heir of Executor or Administrator to my Estate ther is none or shall be any as this my last Will and Testament to them heir heires and assigns forever and I do hereby utterly disallow revoke and disannual all and every other former Testament & Will Legacies and Executors by me in any ways before this time named willed & bequeathed, ratifying and confirming this and no other to be by Last Will and Testament

and as for my Loving Wife Joana she shall have her maintenance with my two sons Jenkens and Thomas Phillips out of my Estate and as for my two sons

  • Milford and
  • John Phillips and my daughter
  • Cathrone Phillips

or either of them their heirs which shall or will claim any rite to my Estate my three Executors or one of them shall pay them and each of them one Shilling sterling and no more this is my Last Will and Testament In Witness whereof I have hereunto set my hand and seal. At a court continued and held for Loudon October 15 1766 this Will was proved by the oath of Jonas Potts (blacksmith), Thomas Phillips (Waggener) and Mary Phillips the witnesses thereto and ordered to be recorded and on the motion of Jenkin Philips Junr and Thomas Philips two of the Executors therein named who made oath according to law certificate is granted them for obtaining a Probate thereof in due form giving security whereupon they together with Thomas Philips (wagener) and Samuel Butcher their securities entered into and acknowledged their bond in the penalty of five hundred pounds current money with condition as the Law directs and liberty is reserved to Jenkin Philips the other Executor named in the said Will to join the the Probate thereof when he shall think fit.
