About Thomas Simms, Sr.
A Patriot of the American Revolution for Virginia. DAR Ancestor # A104063
Moved to Spotsylvania Co., VA in 1733. His will was written the day his wife, Rebecca died. His will names his children.
Thomas Sims was born in Richmond Co., Sittenbourne Parish, Va. a bout 1702. After his father's death in 1716 he was under the supervision of Capt. Nicholas Smith. At about the age of 20 he received control of the land left him by his father. Thomas married Rebecca Petty, daughter of Thomas and Catherine (Garten/Garton ) Petty on Nov. 30, 1725, in Richmond Co., VA. By 1733 he had moved inland to Spotsylvania Co., VA, in the area that became Orange Co. in 1734 and Culpeper Co. in 1748 (Madison Co. was not formed until 1793, so he never lived in that county). He resided in that part of St. Marks Parish that became Brumfield Parish i n 1752. On the same day that Thomas Sims bought land In Spotsylvania Co., his father-in-law Thomas Petty obtained neighboring lands, so it is likely that the Sims and Petty families moved together. Thomas Sims's will was dated April 21, 1785, and was proved in Brumfield Parish, Culpeper Co., VA, on July 18, 1785. From his will and other records, his children can be established to be Thomas, William, James, Elijah, Amy, Sarah Jane, Zachariah , Richard, Ann, and Jeremiah (the last died in 1768 and was not in his will).
Thomas was the son of William and Amy (Clark) Sims. William appears in Richmond Co., Sittenbourne Parish, VA, in 1707, when property deeds were recorded in which wife Amy released dower rights. The name of the wife of William Sims is established from the will of Robert Clark, dated Feb. 6, 1707, in Richmond Co., Sittenbourne Parish, naming daughter Amy and William Sims her husband. Richmond Co. was formed when Old Rappahanock Co. split into Richmond and Essex Counties in 1692. Old Rap had been formed from Lancaster Co. in 1656. William left a will dated April 28, 1716, and proved August 1, 1716 in Richmond Co. In this will he names only his son Thomas, a minor. Thus Thomas was born ca. 1695 , no earlier, in agreement with the 1702 date quoted above. That William Sims had a son Thomas in the same county and parish in which our later Thomas Sims lived (Richmond) is strong evidence that Thomas Sims the son of William was the man who later married Rebecca Petty.

6. WILLIAM SIMS, b. c. 1660-1670 76 at Somerset,77 Eng. He m. c. 1665 78 (where?) Amy Clark.79 [Petty, in referring to the wife of this William Sims, calls her "Amy (or Anne) Sims."] He had land in old Rappahannock 80 Co., VA, (now Essex Co., VA) on 14 May 1686.81 He was constable in 1686.82 He was living in Sittenbourn Parish, Richmond Co., VA, by 83 1707.84 He d. between 28 Apr. and 1 Aug. 1716 85 apparently at Richmond Co., VA.86 Petty (p. 2) says about this William,
William Simms first appears in the records of Richmond County, Virginia, in 1705, when he sold land that had previously been granted to John Weire.87 William was the son of William and Mary Sims of New Kent County.88 This is the weak link in the chain, and is support[ed] largely by circumstantial evidence. In 1711 William Jr. filed a deed89 in Richmond County, granting a large piece of land to Mathew Beane, his son in law. Mathew was married to Mary Simms in 1710.90 This deed indicates then that William had children born about 1690. He mentioned another Son in Law Thomas Scott in the same deed. Thomas Sims was evidently the baby in the family. In that same deed Thomas Paty was a witness, fully 10 years prior to his daughter being married to Thomas Simms. William Jr. was then born about 1668. William Sims Sr. by all accounts was married about 1665 and had sons Thomas, William, Richard, and a daughter Amy or Anne whose christening was entered in the minutes of St. Peter's Church in New Kent County.91 William Sr.'s sister Elizabeth Langdon, referred to Amy, daughter of her brother William in her will, and Richard Sims, of Lewisham in Kent, referred 92 to the sons of his brother William as Thomas, William, and Richard. Richard of Lewisham was mistaken in his will in 1723, and referred to his brother William as deceased, and to William's son William as living, when it was just the other way around. But then in those days when communications were so bad, and long apart, it wouldn't be [surprising] in an old man thinking that it was William Sr. who died in 1716 instead of William Jr.

In the name of God Amen I THOMAS SIMS SENER of Brumfield Parish and County of Culpeper being Sick and weak in body but of perfect mind and memory Thanks be given to God Therefore Calling to mind the Mortality of my body and knowing that it is Appointed for all men once to die do make and Ordain This my last Will and Testament that is to say Principally and first of all I do give and Recommend my soul into the hand of the Almighty God that gave it and my body I recommend to the Earth to be buried in a decent Christian Burial at the Discretion of my Executors nothing doubting but at the General Resurrection I shall reieve the same again by the Mighty power of God and as touching such worldly Estate wherewith it hath pleased God to bless me in this life I give devise and Despose of the same in the following Manner and form Imprimis.
Item first of all I do Give and bequeath and bequeath to my ELDEST SON THOMAS SIMS JUNR. that part of my Estate that fell to him by division, and Likewise I do give and bequeath to my son Thomas Sims my negroe woman by name Milley and her Child to him and his heirs Lawfully begotten forever, Likewise my son Thomas Sims Juner is to pay Thirty pounds in gold or silver to my son William Sims Deceased Children Six Pounds to each Child as they come of age and other little debts comeing against me-
Item Secondly I do give and bequeath to my SON JAMES SIMS my negro man Peter and all that fell to him by Division to him and his Heirs Lawfully begotten forever Likewise I do give and bequeath to ELIZABETH SIMS WIFE OF JAMES SIMS my Gilt Looking Glass and I desire at her Death that one of her sons may have it.
Item Thirdly I do give and bequeath to my SON ELIJAH SIMS the land he lives on The Gardon excepted and Likewise a Negro boy by name Abraham and all that fell to him by Division to him and his heirs sons of his first wife Lawfully begotten forever-
Item Fourthly I do give and bequeath to my DAUGHTER AMAY BOBO a negro woman by name Cate, and all of her Children, and I desire if JOHN SIMS lives with ABSALOM BOBO and his wife untill he comes of age they may give him one of the Negro Children if they see proper, This Negroe woman Cate and all her Children, and all that fell to her by Division is to her her and her heirs Lawfully Begotten forever-
Item Fifthly I do give and bequeath to my TWO GRAND DAUGHTERS LUCY AND ANNA JONES DAUGHTERS OF MY DAUGHTER SARAH JONES DECEASED a Negroe Woman by name Rose and a boy named Peter and all that part that fell to my said daughter Sarah Jones by Division to them and Their heirs Lawfully Begotten for Ever, This Estate they are to recieve at the day of of Marriage or Coming to Lawful age-
Item Sixthly I do give and Bequeath to my SON ZACHARIAH SIMS a Negro man by name Moses and all that fell to him by division to him and his heirs Lawfully Begotten for ever
Item Seventhly I do give and Bequeath to my SON RICHARD SIMS a Negro woman by name Dafne, and Likewise Thirty odd Acres of Land and all that fell to him by Division to him and his heirs Lawfully Begotten for Ever.
Item Eighly I do give and Bequeath ANN GRAVES an Negroe woman by name Winney and her Child and all that fell to her by Division to her and her Heirs Lawfully Begotten forever
Item Ninthly I do Desire that my Feather bed and Furtinure and what other things I possess may be sold to the highest bider in the Family and the Money Rising Therefrom be Equally Divided amongst all my Children-
And Lastly I do appoint my sons Thomas and James Sims my hole and Sole Executors of this my Last Will and Testament hereby Revoking all former wills and Declaring this to be my my last will and Testament.

At a Court held for Culpeper County the 18th day of July 1785
This last Will and Testament of Thomas Sims Decd was Exhibited to the Court by thomas Sims one of the Exors therein named and was proved by the Oaths of Edwd Sims & William Mason two of the Witnesses thereto & Ordered to be recorded And on the Motion of the said Executor Certificate is granted them for obtaining a probate thereof in due form they having made oath thereto and given bond & Security according to Law Liberty being reserved for the other Exor therin named to Qualify when he may think fit.

Virginia: In Culpeper County Circuit Court Clerk's Office. I, C.T. Guinn, Clerk of the Circuit Court in and for the said County aforesaid in the State of Virginia, do hereby certify that the foregoing is a true copy of the will of Thomas Sims Senior, which was probated in this office on the 18th day of July 1785, and is of record in this office in Will Book "C", page 129 Given under my hand this 23rd day of November, 1785.
