SOURCE: Charles Owens book. In 1843-44 Webster moved his family to Platte County. MO. He died 4 June 1852, possibly in Rockcastle County, KY while visiting relatives. There are indications that Webster married twice after Phoebe Cummins, second wife Mrs. Delilah Denny, third was Isabel ? age 50, born in KY and listed with Webster in the 1850 Census of Platte County, MO.

I wanted to tell you that we are now very sure that Webster Owen only had one wife, Isabel Cummins, D/O Moses Cummins and Elizabeth "Betty" Garrett. Carol Thatcher Solt, a descendant of Webster, has a letter written 4 Jan. 1854, by Isabel's sister Rebecca Cummins Umfleet of Lawrence Co., IL in which she inquires about Isabel's children etc. she also mentions hearing from three of their brothers, John, Daniel and William Cummins. I am still trying to transcribe the letter as it is very hard to read, it is kind of sad too, as she mentions the death of one of her own and how hard times are - in any event it does indicate that Isabel was the mother of Webster's 12 children. I have over 970 individuals listed as descendants of Webster and Isabel - I'm sure there are others that have not turned up yet.

The appointment of David Fleming on application for letters of administration on the estate of Webster Owens deceased states to the best of his knowledge and belief that the deceased died without a will and that he left a wife & 12 chi ldren, towit: G L (Granville Love) Owens, Wm H. (William Harvey) Owens, Nelson (David Nelson) Owens, Wilmouth Higgins, Winefred Ann Owens, Malinda Owens, Henry L (Lankford) Owens, Mary Owens, John (Francis) Owens, Alfred ( S.) Owens, Cynthia (Ann ) Owens and (Elizabeth) Edna Owens, all residents of the State of Missouri and furthermore that he will make a perfect inventory of and faithfully adminster all the estate of the desceased and pay the debts as far as the receipts will release an d the court directs and will account for and pay over all receipts that shall come to his posession or knowledge. Ten dollars in full of all the claims I have in and to the damages assessed by the commissioners, who marked out a state road across the land of sd . decd. and assessed the damages in my name instead of assessing to the estate. The following letter from James M. Smith of Mt. Vernon, KY was found in the probate records. Mr. Smith was a lawyer who handled the early applications of the heirs of David Owen in their effort to secure a Revolutionary War Pension in the nam e of their deceased mother, Winefred Mullins Owens. Also involved was another Mt. Vernon lawyer, James S. Fish, who accused Mr. Smith of "fraud and duress" in the names of the Owens heirs and said that Mr. Smith had drawn up "fraudently papers" an d described Mr. Smith as a "violent enemy" of mine. Mr. Smith, in turn, accused Mr. Fish of the same offense. In October 1853, the Owens heirs filed an affidavit, exonorating Mr. Smith of any charges made by Mr. Fish. CSO.

Mount Vernon Rockcastle County Kentucky 22 Sept. 1853 To The Heirs of Webster Owens deceased

After an effort of 3 years I have succeeded in obtaining a pension of $876. dollars for the heirs of Winefred Owens wife of David Owens deceased, the money has to be dawn (drawn) at Louisville, Ky enclosed yo u will find a power of attorney for your administrator or the administrator of Webster Owens deceased, to sign and when the money is dawn (drawn) I will remit you your part, it cost me considerable money and trouble I had to have deppositons take n in North Carolina my contract was if I obtained the pension I was to have one half me paying all cost if I didant obtain the pension. I will give directions for fear you may miss preparing the enclosed form if the least thing is wrong no money will be dawn (drawn)


on page (1.) the 2 first blanks the adminstrator will put his name jus t before the word (administrator) and (who is the administrator) just above J. P.fill up the date of the month and the month, the administrator places his name just after X that top and above adminstrator of Webster Owens deceased, the Squire mus t Sign his name on the left just before J. P. Have 3 witnesses to Sign after the figures 1. 2. 3. on the left bottom, turn over on page (2) the administrator inserts his name just below you will fill up the day of the month and the month that th e administrator wright his name after (x) and above administrator of Webster Owens deceased on the left have a witness the Squire will do for one then the Squire Certificate follows fill up the dates and the administrator puts his name in the blan k near the middle of the Squires certificate the Squire puts his name on the right just before J. P. And 2 witnesses sign it on the left beside the Squire on the (3) page follows the clerks certificate which he will know how to fill and place hi s seal of office
just below the clerk will copy the order of court appointing the administrator name in the order that he gave bond and approved Security as the law directs and the clerk will certify thatr it is a true coppy of the orde r of the court appointing him administrator Sign his name and affix his seal of office agane be sure and have the foregoing directions complied with or the money cant be dawn (drawn) and enclose the same to me as soon as you can and I will remi t you your money by check on Newyork. You will please inform me the County and State John Owens lives none of the relatives hear know wher he lives he has a Share coming to him your early attention to the foregoing.
