Patrick Waus of Barnbarrach, George McDowell of Derregill younger, Gavin Dunbar of Bandone and Mr. William McGowin Commissary of Wigton - infeft Robert Lyndesay servitor to the said Sir John Dunbar, as attorney for Alexander Dunbar grandson of Sir John, in the 10 merkland of Egernes, Carsquhill and Lurgis. 3 December 1588: Procuratory of Resignation by John Vaus as fiar and son and heir apparent to Sir Patrick Vaus of Barnbarroch senator of the College of Justice and franktenementar of the lands, directed to [] conform to contract with Alexander Stewart of Garleyis dated 15 Oct. last - to resign into the hands of the Crown as superior all his right to the patronage of the parish kirk of Pennynghame and presentation thereto - in favour of the said Alexander Stewart. Subscribed at Edinburgh by Sir Patrick on 3 Dec. and witnessed by David Lautie younger, David Kynneir his servitor and James McCulloch of Drummorrell - and by the said John Vaus at Wigton on 20 Dec. witnessed by Alexander Ahannay of Sorbie, Gavin Dunbar of Baldoune and John Ahannay of Kirkdaill. 2 tags and seals in good preservation. Endorsed with certification at Holyroodhouse on 12 March 1588/9 by John Gray servitor to Sir Robert Melville of Murdocairney Treasurer Depute, which resignation was accepted by John Stewart one of H.M. "virlattis" as attorney for Garlies and witnessed by Andro Sinclare, George Home gentlemen of H.M. Chamber, Jerome Lyndesay, William Elphinstoun and James Eldsmostoun. 6 January 1595-96: Precept under the quarter seal narrating that John McDowell of Logane had supplicated the Lords of Council and Session as follows. He had been infeft in half of one merkland of Killumquha and in 1½ merkland of Killumquha-Agnew, nevertheless Janet Agnew and Walter Agnew pretended possessors of the 2½ merkland of Killumquha-Agnew held of the said John McDowell, and Alexander Agnew, their subtenant, had been working the ½ merkland as well as the 2½ merkland, and would not suffer the said John McDowell's superiority over the said ½ merkland, so that he cannot work it. Therefore it is necessary that the ½ merkland be divided from the 2½ merkland and the sheriff should decide the division. But it was notorious that Andrew Agnew is sheriff and brother german of the said Alexander Agnew, the subtenant, and so is a partial judge. So it is necessary that an unsuspect judge should hear the case. The Crown therefore appoints John Neilson of Craigceffie, John Kennedy of Grenan, John Dunbar of Mochrum, William Kennedy of Gillaspik, and Gavin Dunbar of Baldoune as sheriffs in that part to hold court fordivision of the land.
