This Terms of Use Agreement ("Agreement") between you and Geni.com ("Geni " or the "Company") sets forth the legally binding terms for your use of the Geni.com website (including all the areas of the site) and any successor websites ("Website") and the services, software, and applications the Website provides online and makes available offline (collectively, "Geni Services"). By accessing or using any of the Geni Services, you signify that you have read, understood, and agree to be bound by this Agreement and to the collection and use of your information as set forth in the Geni Privacy Policy, whether or not you are a registered user of the Geni Services.
Please read this agreement carefully to ensure that you understand each provision.
For U.S. customers and U.S. individuals: this Agreement includes arbitration and class action waiver provisions that waive your right to a court hearing, right to a jury trial, and right to participate in a class action. Arbitration is mandatory and is the exclusive remedy for any and all disputes unless specified below. These provisions form an essential basis for our Agreement.
This Agreement includes the acceptable use of the Geni Services and content posted on the Website, and your rights, obligations and restrictions regarding your use of the Geni Services. Please see Geni's Privacy Policy for more information about how we collect, use, and share information on the Website.
Geni may modify this Agreement at any time and such modification shall be effective upon posting by Geni on the Website. You agree to be bound to any changes to this Agreement when you use the Geni Services after any such modification is posted. It is therefore important that you review this Agreement regularly to ensure you are updated as to any changes. Your continued use of the Geni Services after any such change constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Geni Services. It is further clarified that as long as you keep an account on Geni and refrain from deleting it, this will mean that you are continuing to use the Geni Services and agree to be bound to any changes to this Agreement.
Please choose carefully the information you post on Geni.com and that you provide to other users. You agree that your Geni.com profile and other Content shall not include any photographs containing nudity, or obscene, lewd, excessively violent, harassing, sexually explicit, otherwise objectionable subject matter, or otherwise violate this Agreement, including section 7 below. Despite this prohibition, information provided by other Website Members (for instance, in their profile) may contain inaccurate, inappropriate, offensive, sexually explicit, or otherwise inappropriate material and Geni assumes no responsibility or liability for this material. If you become aware of misuse of the Geni Services by any person, please contact Geni at misconduct@geni.com. You should not provide Geni the email address of anyone under 13 years of age (16 in the European Union) as a part of Geni's efforts to protect children (see our safety tips).
Geni reserves the right, in its sole discretion, to reject, block, refuse to post or remove any Content or other posting (including private messages) by you, or to restrict, suspend, or terminate this Agreement or your access to all or any part of the Geni Services at any time, for any or no reason, with or without prior notice, and without liability.
Geni Accounts, Password and Email. Your Geni account gives you access to the services and functionality that we may establish and maintain from time to time and in our sole discretion. We may maintain different types of accounts for different types of users. If you open a Geni account on behalf of a company, organization, or other entity, then (a) "you" includes you and that entity, and (b) you represent and warrant that you are an authorized representative of the entity with the authority to bind the entity to this Agreement, and that you agree to this Agreement on the entity's behalf. When you sign up to become a Member, you will also be asked to choose a permanent password and supply your email address. You are entirely responsible for maintaining the confidentiality of your password. You agree not to use the account, username, or password of another Member at any time or to disclose your password to any third party. You agree to notify Geni.com immediately if you suspect any unauthorized use of your account or access to your password. You are solely responsible for any and all use of your account. By registering and providing your email address, you consent to Geni.com communicating with you by email, including without limitation, to provide you notice of any security breach in lieu of other written notification. You may opt-out of this email communication by contacting us at misconduct@geni.com.
By providing Geni your email address you consent to our using the email address to send you Service-related notices, including among other things notices required by law, in lieu of postal mail. You may not opt out of Service-related e-mails. We may also use your email address to send you other messages, including changes to Geni features and special offers. General. Member agrees to pay for all products ordered through the Website using the payment method indicated, and provides Geni express authorization to charge said fees to the Member's payment provider at time of purchase or renewal. Fees owed depend on the specific type and quantity of Geni products, services, information, or deliverables (collectively "Deliverables") ordered. Payment of fees shall not be contingent on any events other than the delivery of the ordered Deliverables. Any attorney fees, court costs, or other costs incurred in collection of delinquent undisputed amounts shall be the responsibility of and paid for by Member. If payment is not current, Geni may immediately cease to provide any and all Deliverables to the Member.
It is the Member's responsibility to promptly provide the Company with any contact or billing information changes or updates (including phone number, email address, credit card numbers, etc.). Account updates should be made online via the "Settings" tab within the "Billing Information" section, once Member has logged into www.Geni.com. Geni does not validate all credit card information required by the Member's payment provider to secure payment.
Subscriptions. Your Geni premium membership may start with a free trial. The free trial period of your membership lasts for 14 days, or as otherwise specified during sign-up. You must have a current valid accepted payment method as indicated during sign-up to use a premium membership. Limit one free trial per user.
Prepaid fees for annual and multi-year subscriptions will be refunded based on the number of months remaining on the contract period, beginning with the month following receipt of written cancellation, but may be subject to adjustment according to current product pricing and subject to adjustment for any taxes, incentives or discounts provided for said prepayment. A Member choosing to cancel a prepaid subscription prior to the end of its prepaid term may also be subject to a $15 processing fee. No partial month refunds will be provided.
Subscriptions will automatically renew using the Member's current credit card account number unless Member cancels their subscription on the Website at https://www.geni.com/account_settings/premium_account three (3) days prior to the renewal date to cancel such subscription. All cancellation requests will be processed within five (5) business days. Once the cancellation is processed, a confirmation email will be sent via the Member's email account on record with Geni. If Member has a question about a cancellation, Member should contact Geni at subscriptions@geni.com. The fees paid for monthly subscriptions are non-refundable, regardless of whether the subscription is terminated prior to the end of the then-current billing period. The Company reserves the right to change its fees or billing methods at any time.
The Member must notify Geni about any billing problems or discrepancies within 90 days after charges first appear on their Account statement. If it is not brought to Geni's attention within 90 days, Member agrees to waive their right to dispute such problems or discrepancies.
Without limiting the foregoing, it is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act of 1998 ("DMCA"). The DMCA provides remedies for copyright owners who believe that material appearing over the Internet infringes their rights under United States copyright law. To learn more about the DMCA, please visit the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf.
If you are a copyright owner or an agent thereof, and you believe in good faith that any content hosted on the Website infringes your copyrights, then you may submit a notification pursuant to the DMCA to our Designated Copyright Agent, either by mail to: Copyright Notices, Geni.com, 2080 Empire Avenue #1233, Burbank, CA, 91504 or by email to: misconduct@geni.com.

If you are unsure whether you hold rights to a particular work or if the material you are reporting is in fact infringing, please consult an attorney or another adviser, as Geni cannot provide legal advice. Note that there can be penalties for false claims under the DMCA.
The Geni Services are controlled from our facilities in the United States. Geni makes no representations that the Geni Services are appropriate or available for use in other locations. Those who access or use the Geni Services from other jurisdictions do so at their own volition and are responsible for compliance with local law.
Arbitration is a manner of resolving a "Claim" without filing a lawsuit. "Claim" means any dispute, actions, or controversies between you, Geni, or any involved third party relating to your account, the Website or the Geni Services, your relationship with Geni, communications from or with Geni, this Agreement (including those relating to the formation, breach, termination, enforcement, interpretation, validity, scope, or applicability of the Agreement and this arbitration agreement), the Privacy Policy and any documents or agreements incorporated by reference in any of the foregoing. You, Geni, or any involved third party may pursue a Claim. Except as otherwise provided herein, should Geni have any Claims against you, it agrees to resolve such Claims exclusively through final and binding individual, confidential arbitration. Likewise, except as otherwise provided herein, should you have any Claims against Geni, you agree to resolve such Claims exclusively through final and binding individual, confidential arbitration. By agreeing to arbitrate, you waive the right to go to court and agree instead to resolve any Claims exclusively through final and binding individual, confidential arbitration. This arbitration provision sets forth the terms and conditions of our agreement to final and binding confidential arbitration and is governed by and enforceable under the Federal Arbitration Act (the "FAA"), 9 U.S.C. §§ 1-16, as amended. You agree that this Agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods and that any and all Claims shall be subject to the terms of this provision.
Notwithstanding the foregoing, and as an exception to final and binding confidential arbitration, you and Geni both retain the right to pursue, in small claims court, any claim that is within that court's jurisdiction and proceeds on an individual (non-class and non-representative) basis. Geni will not demand arbitration in connection with any individual claim that you properly file and pursue in a small claims court, so long as the claim is and remains pending in that court on an individual basis. The following claims shall not be subject to final and binding arbitration and must be adjudicated only in the courts located in Wilmington, Delaware: (i) infringement or validity of our intellectual property rights or the intellectual property rights of a third party; or (ii) an action by Geni for injunctive or other provisional relief for breach or threatened breach of this Agreement. You expressly agree to refrain from bringing or joining any claims that are excluded from final and binding arbitration pursuant to this subsection "2" in any representative or class-wide capacity, including but not limited to bringing or joining any claims in any class action or any class-wide or representative arbitration. Small claims matters may be filed in any small claims court with personal and subject matter jurisdiction over the parties. For all other matters excluded from final and binding arbitration by this subsection "2," the parties consent to exclusive jurisdiction and venue in the courts located in Wilmington, Delaware, and forever waive any challenge to said courts' jurisdiction and venue.
Before initiating any Claim against the other, you and Geni agree to first contact each other with a written notice of the dispute, stating the name, address, and contact information of the party giving notice; the facts giving rise to the Claim; and the relief requested, and including all relevant documents and information. You may send the written notice of dispute by e- mail to legal-help@geni.com or by writing to Geni.com, 2080 Empire Avenue #1233, Burbank, CA 91504 USA, by courier or registered mail. Geni will contact you by letter at the billing address you provided to us or at the email address you provided to us. If the dispute is not resolved within 60 days after receipt of the written description of the dispute, you and Geni agree that all Claims shall be resolved exclusively through the dispute resolution provisions below.
You and Geni agree to commence any arbitration proceeding within 1 year after the Claim arises (the 1-year period includes the required pre-dispute procedures set forth above) and that any arbitration proceeding commenced after 1 year shall be forever barred.
The arbitration may be conducted by telephone (or other remote means) or by written submissions in Wilmington, Delaware, in the city or county where you reside, or another forum mutually agreed upon by you and Geni.
All Claims other than those exempted under subsection "2" above shall be submitted to final and binding individual, confidential arbitration before a single arbitrator of NAM (National Arbitration and Mediation). The arbitration will be conducted in accordance with this Agreement and this arbitration agreement and the provisions of NAM's Comprehensive Dispute Resolution Rules and Procedures, the Mass Filing Supplemental Dispute Resolution Rules and Procedures, and any supplemental rules and fee schedules in effect at the time of submission of the demand for arbitration and as applicable (the "NAM Rules"). The arbitrator shall be selected by agreement of the parties or, if the parties cannot agree, chosen in accordance with the NAM Rules. The NAM Rules are available at https://namadr.com/resources/rules-fees-forms/ or by calling 1-800-358-2550. The arbitrator shall have the exclusive and sole authority to resolve any dispute relating to the interpretation, construction, validity, applicability, formation, or enforceability of this Agreement, the Privacy Policy, any documents or agreements incorporated by reference in any of the foregoing, and this arbitration provision. The arbitrator shall have the exclusive and sole authority to determine all threshold arbitrability issues, including whether any Claim is arbitrable and whether this Agreement is unconscionable or illusory, in whole or in part, and any defense to arbitration, including waiver, delay, laches, or estoppel. The arbitrator shall have the exclusive and sole authority to determine whether this arbitration agreement can be enforced against a non-signatory to this agreement and whether a non-signatory to this agreement can enforce this provision against you or Geni. Payment of all filing, administration and arbitrator fees will be governed by the NAM Rules. For individual, non-mass arbitrations, Geni will pay the fees charged by the arbitrator for Claims totaling less than $750, unless the arbitrator determines the Claims are frivolous, in which case, Geni reserves the right to seek reimbursement from you for any arbitrator fees paid. Likewise, Geni will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the Claims are frivolous. In all other respects, the parties shall each pay their own additional fees, costs, and expenses, including, but not limited to, those for any attorneys, experts, documents, and witnesses. The arbitrator shall follow the substantive law of the State of Delaware without regard to its conflicts of laws principles. Any award rendered shall include a confidential written opinion and shall be final, subject to appeal under the FAA. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
This provision survives termination of your account or relationship with Geni, bankruptcy, assignment, or transfer. If the class action waiver is deemed unenforceable (i.e., unenforceability would allow arbitration to proceed as a class or representative action), then this entire arbitration provision shall be rendered null and void, and you and Geni shall be deemed not to have agreed to arbitrate Claims. If a portion of this arbitration provision (other than the class action waiver) is deemed unenforceable, the remaining portions of this arbitration provision shall remain in full force and effect.
Geni reserves the right to amend this arbitration provision at any time. Your continued use of the Website and/or the Geni Services is affirmation of your consent to such changes. Should the changes to this arbitration provision be material, Geni will provide you notice and an opportunity to opt-out. Your continued use of the Website and/or the Geni Services is affirmation of your consent to such material changes.
After the required pre-dispute resolution procedures in subsection "3" above are exhausted, and to increase efficiency of resolution, in the event 25 or more similar arbitration demands against Geni are filed by or with the assistance or involvement of the same or coordinated law firm(s) or organization(s) ("Mass Arbitration"), you and we agree that such Mass Arbitration shall be governed by the NAM Rules in effect when the Mass Arbitration is filed or coordinated, excluding any rules that permit arbitration on a class-wide or other representative basis, and under the rules set forth in this Agreement and this arbitration agreement. You and we agree that the Mass Arbitration shall be resolved using NAM's Mass Filing Supplemental Dispute Resolution Rules and Procedures, available at https://www.namadr.com/ . The individual demands comprising the Mass Arbitration shall be submitted on NAM's claim form(s) and as directed by NAM. Pending resolution of any dispute concerning the administration of the Mass Arbitration by NAM, you and we agree that all arbitrations comprising the Mass Arbitration (and any obligation to pay arbitration fees) shall be stayed. Disagreements over the applicability of this Mass Arbitration process will be settled in a single, consolidated arbitration proceeding before NAM that includes all affected parties and will be resolved by a single arbitrator subject to the requirements of this section. Notwithstanding any provision in this Agreement to the contrary, any Mass Arbitration shall take place in Wilmington, Delaware or, if the parties prefer, by video conference or other remote means. The parties may also agree to conduct arbitration based on written submissions alone. If for any reason the provisions in this subsection "9" are found to be unenforceable, or if for any reason NAM is unable to administer the Mass Arbitration, then the disputes comprising the Mass Arbitration shall be administered by ADR Services, Inc. ("ADR Services") consistent with the provisions of this arbitration agreement and this Agreement and in accordance with ADR Services' rules and procedures, including any supplementary rules and fee schedules then in effect. ADR Services' rules are available at https://www.adrservices.com/services-2/arbitration-rules/.
In the event that 25 or more Mass Arbitration demands are allowed to be submitted for arbitration, NAM or ADR Services, as applicable, shall: (i) administer the arbitration demands in 25 batches, with the discretion to create additional batches to facilitate the efficient resolution of demands; and (ii) apply a single set of applicable arbitration fees per batch for each side as set forth in the applicable fee schedule governing mass arbitrations. You agree to cooperate in good faith to implement this batch approach to facilitate the efficient resolution of claims. Notwithstanding the foregoing, Geni reserves all rights and defenses as to each and any Claim and claimant.
You have the right to opt out of this arbitration provision as follows: (a) if you signed up to Geni after August 5, 2026 (the "Arbitration Effective Date"), then you have 30 days from the date you signed up to opt out; or (b) if you signed up to Geni before or on the Arbitration Effective Date, then you have 30 days from the Arbitration Effective Date to opt out, as Geni will attempt to inform you by email within 10 days of the Arbitration Effective Date about the changes in this Agreement that include the arbitration provision. To opt out of the arbitration provision, write to us by sending an e-mail with the subject of "Arbitration Opt-Out" to opt-out@geni.com, or via courier or registered mail at Geni.com, 2080 Empire Avenue #1233, Burbank, CA 91504 USA, with the notation "Arbitration Opt-Out". When opting out, it is required to provide your account ID or the email address you used to sign up to Geni. If you do not opt out within the timeframes designated in this subsection, you are not eligible to opt out of this provision and must pursue your claim through individual binding arbitration, except as set forth above. If you opt out of the arbitration provision, all other parts of this Agreement will continue to apply. Opting out of this arbitration provision has no effect on any previous, other, or future arbitration agreements that you may have with Geni.
