Son of Richard and Elizabeth Ashby Simms. Brother of Frances A. Simms. Uncle of Mary Peters Ringo (mother of Johnny Ringo) and Augusta Peters Inskep Younger (wife of Thomas Coleman Younger, uncle of the outlaw with the same name). Was married briefly to Zerelda Elizabeth Cole James (Simms Samuel(s)). While married to Zerelda, Ben was none to kind to his stepchildren, "disciplining" them severely. His death was complications of a fall from his horse. This death also solved other problems as Zee was on the verge of divorcing him.

Benjamin Simms (born circa 1830 – d. January 2, 1854) was a wealthy farmer who married widow Zerelda James on September 30, 1852. The marriage proved to be an unhappy one, largely because of Simms' dislike of Frank James and Jesse James, to whom he was reportedly cruel. Zerelda left Simms, who died on January 2, 1854, when he was thrown by his horse.
