Capt. James Walker Jones
The following is incorrect regarding this James W. Jones. It appears to pertain to a much younger man, a James M. Jones.

NOTE: It appears that he either had a son very young or perhaps a younger brother aged 15-19 living with him living with him, as well as perhaps a son 10-14. He and his wife are both 20-29. He had three slaves.
1840 census Henderson County, North Carolina Name: James W Jones
NOTE: James Jones' age is here listed as 20-29 but that is clearly an error in the wrong column since his wife's in 30-39, which his should be as well. This census seems to be short one daughter in this census, based upon the following census (Maron b. 1830, Sarah 1832 and Matilda 1834). The two sons under age 5 would be William (b 1838) and George (b 1840).

Name: James Walker Jones
In 1870 Captain James Walker Jones had a 440 acre farm valued at $7/acre along the French Broad River in Henderson County. It was known as the J. W. Jones Farm and was along what is now known as the Jeffress road near the Bent Creek area. The Jones cemetery is there and is where Captain Jones was buried in 1872.
Jones was commander of a unit that committed illegal actions by murdering fellow citizens in an internal political struggle in Columbus, Polk County, NC in December 1864 (see Project "Not Very neighborly").
Mahulda Williams Weaver, widow of Frank Weaver, one of the men executed, sued Jones beginning in 1872. Jones died while this suit was in process, and his estate, administrated by his son Dan, lost the lawsuit to Mahulda in 1873. Dan M Jones was the administrator of the Jones estate but he left the state "without setting up the said estate and that said estate is likely to be wasted by reason of the absence of the said administrator as there is important litigation pending in this state against the said estate." Dan Jones was replaced by Captain Jones' daughter, Patience Louise (Jones) Johnson, in 1879.
(Patience was born July 15th, 1855 and died July 22nd, 1936).
James Walker Jones was sued by Mahulda Weaver over the murder of her husband who won a judgment of $1500 plus interest. Jones died in 1872 but the fight over the money continued for many years. At one point P. L. Johnson was the administrator of Jones estate, but she kept dragging her feet until the court replaced her with George G. Weaver, F A Weaver's son, as administrator of whatever was left in 1887. In the end, we have Mahulda suing George on the paperwork and it appears George sold the property and may have gotten as much as $2100 for it.

In some of the papers as late at 1887, there is mention of the Jones estate bringing around $12,000 and two of the heirs, P.L. Johnston and Sarah Allen, were entitled to $7000 each.
I think the original case was Sept 8, 1878, but the "8" could be a "0" thus 1870. Either way, it went to the Supreme court of appeals June 14th, 1880 and a new trial was denied.
On January 4th, 1882 (C?). M. Pace (probate judge of Henderson County) gave Johnston 10 days to appear and explain why she should not be removed as administrator of the Jones estate.
This was still going on and in the Spring of 1887, it looks like P.L. Johnston tried to dodge the judgment by claiming it had exceeded the statute of limitations.
It looks like everything was mostly settled in 1888 when the property was sold to G.M. Roberts for $2100 dollars and it was used to settle the debt. On this paper, it has M.H. Weaver as the plaintiff even though she was dead vs her son, G. G. Weaver who was named administrator of the Jones estate.
In the January term of 1880 the North Carolina Supreme Court upheld a lower court decision in the case of Weaver v. Jones. The case is about Dan Jones, the son of Captain Jones trying to get the judgment (won by Mahulda Weaver against Captain Jones for his part in the murder of Frank Weaver) thrown out. The basis of this was that there were no assets and the estate of Captain Jones had been fully administered. He also fell back on the 1866-67 North Carolina amnesty act. The lower court judge found these claims baseless in 1879 and said the Weaver judgment stood.
What can be gleaned from reading between these lines is the following:
The case was won by Mahulda Weaver in 1873 and the jury awarded her $1,500 which was not paid by Dan Jones, the first executor and he tried to get the judgment thrown out in 1879 but failed.

Another Jones cemetery can be found on the old Nesbitt Dairy off Jeffress Road in Mills River.
"We can find no relationship between this family and the rest of the Jones' in the county," said George Jones, a founder of the Henderson County Historical and Genealogical Society, who is a descendant of John Jones Sr.
In the lawn of veterinarian Joe Nesbitt can be found headstones of Nancy, wife of J.W. Jones, 1806-?; James Walker Jones, 1806-1872; Rachel M. 1853, daughter of J.W. and M.A. Jones; and Juriah A. Jones, 1860-1861.
It is known that a descendant of this family, Alexander Jones, was elected to the U.S. Congress twice immediately after the Civil War for this district.
"He was later an ambassador and his last position was with the Port Authority in San Francisco," Jones said.
All the graves are marked with head and foot stones, said Norman Miller, who chairs the cemetery project for the Sons of Confederate Veterans and serves on the county's Cemetery Advisory Committee.
The headstones were standing upright when the cemetery was surveyed by a team with the Historical and Genealogical Society in the late 1980s. The graveyard was then overgrown and not maintained.
"There were a number of unmarked graves," Jones said.
A house was built adjacent to the cemetery and a well-maintained lawn now covers the old cemetery. All the stones are lying flat and grass must be pulled up and brushed aside to read the inscriptions. Four inscribed stones were recently located, with footstones, but no unmarked stones.
The cemetery can be found on the county's GIS cemetery layer.
