on or about the 1st day of September, 1838, Petrus Johannes Haupt was indebted to the PlaintiflF in the sum of £2450 for wine and brandy sold and delivered, for cash lent and advanced, and promissory notes and other documents of debt due and owing to Carel Albrech Haupt. Being a son of the marriage of CA Haupt to Anna Gertruida Haupt nee de Villiers Petrus J Haupt claimed that since his mother's death on the 15th Jan 1836 he had not received his portion of the money left to her children,with her husband as sole executor.
