Body Found in River. The body of Austin J. Nolan (54), far mer, of Hines Hill, was seen floating in the Swan River, about 300 yards from the Barrack Street jetty, at 10.50 a.m. yesterday by passengers on the South Perth ferry. Water-Constable Kinghorn, and Constable Langley recovered the body, which was taken to the Perth Hospital morgue.

ESTATE OF HARRY WILLIAMS (DECEASED).

The Full Court, consisting of Mr. Justice McMillan, Mr. Justice Burnside, and Mr. Justice Booth, last week dealt with an appeal against an order of the Chief Justice in Chambers in connection with the estate of Harry Williams, deceased.

Cecilia Ann Frances Fitzpatrick, a beneficiary under the estate, had applied under a summons to the Chief Justice in Chambers for an answer to the following questions:—

(1) Whether a certain payment alleged to have been made by them of the sum of £530 to Anne Williams, claiming as a creditor of the estate of Harry Williams, deceased, was valid?;

(2) whether the land tax imposed in respect of the real estate of the deceased is chargeable to capital or income account?

The summons was directed to T. F. Quinlan, and Anne Williams, executor and executrix of the deceased's will, and was dismissed by his Honour. The plaintiff appealed to the Court on the second question.

Mr. J. Moss Solomon, Instructed by Mr. S. W. Curtis, appeared for the appellant, and Mr. J. M. Downing for the respondents. The Court held that there was no dispute between the parties, because both had agreed that the land tax should be charged to income, and it had been actually paid.

In the circumstances, lt was stated, his Honour had, as any Judge would have done, dismissed the summons with costs. The appeal was dismissed with costs.
