<p><p>Will of Clarissa (Clarkey) Harding</p></p><p><p>&nbsp</p></p><p><p>Stafford County Will Book GG page 278 - Dated 11 Dec. 1826</p></p><p><p>&nbsp</p></p><p><p>In the name of God, amen, I CLARKEY HARDING of the county of Stafford and commonwealth of Virginia, being weak in body but of sound mind and memory, do make and ordain this my last will and testament hereby revoking all former wills by me made. It is my will and desire that after my mortal remains are committed to the earth in a decent Christian manner, my just debts be paid. Secondly, It is my will that the heirs of my son,Elijah shall not receive the $50 which I agreed to pay them, as a free gift, by an obligation now in the possession of my son Enoch, nor any part thereof; and instead of the said $50, they shall receive the portion hereinafter bequeathed them. Thirdly, I give and bequeath my maid servant Fenton (?) and her future increase to my son, Mark, for and during his natural life, for the exclusive use andbenefit of his children lawfully begotten and after the death of my said son Mark, the said servant maid shall belong to his surviving children and to their heirs forever. Fourthly, I desire that allmy property of every description be sold to the highest bidder at public auction on a credit of 12 months and the proceeds of such sale, when collected be divided among the following named children and grandchildren in the manner following, to wit:</p></p><p><p>&nbsp</p></p><p><p>The said proceeds are to be divided into ten equal parts and my son John is to take one part, Cuthbert another part, Enoch a third part, Frances a fourth part, the heirs of the body of my son Elijah, share and share alike a fifth part, Sarah a sixth part, Nancy a seventh part, Adah an eighth part, Lewis a ninth part and Mark the tenth part. It is of course my wish that my maid servant herein bequeathed to my son Mark should not be sold by my executor: and I also direct that my son Lewis shall take his choice of one of my homes in addition to the part herein bequeathed him and have the same to his use forever. Lastly I constitute and appoint my son Mark executor to this last will and testament. Harding of Marshall County, State of Mississippi, for consent and consideration have made, ordained, authorized, nominated and appointed and by these present do make, ordain, authorize and appoint my father Mark Harding of Stafford County and State of Virginia my true and lawful attorney for me and in my name and for my proper use and benefit to ask, demand, sue for, receive and view all such sums or sum of money arising from my ______of a certain portion of slaves that the said Mark Harding holds a life estate under the will of my Grandmother, Clarkey Harding, and as he the said Mark Harding is desirous to give and divide a certain portion of the said slaves amonghis five children before his death, the said Mark Harding is hereby empowered and fully authorized in every respect to do all things and lawful acts for me and in my name in dividing and apportunity (?) the Negroes in every respect as I myself might or could do were I personally present.
