Will of Josiah Rogers of Branford, Connecticut.

AT A COURT OF PROBATE HELD IN GUILEORD JANUARY YE 24TH:1758 PRESENT: TIMOTHY STONE ESQR JUDGE NATHLL HILL CLERK

Josiah Rogers and Jonathan Rogers Executors of the Last Will and Testament of Mr Josiah Rogers Late of Branford Dec d exhibited ye will which being proved was approved in Court and ordered to be recorded and the executors accepted the trust therein committed to them.

IN THE NAME OF GOD AMEN the nineteenth day of April AD 1757 I Josiah Rogers of Branford in ye county of Newhaven and Colony of Connecticutt in New England being now in my advanced years (but of sound mind and memory thanks be to God) calling to mind my own mortality as knowing it Is appointed for all men once to dieX so make and ordain this my last will and testament Viz.

Principally and first of all I recommend my soul unto ye hands of God that gave it and my body to ye earth to be buried in a decent Christian manner at ye discretion of my executers after named nothing doubting of its Resurrection at ye last day And as touching ye wordly estate with which it hath pleased God to bless me; I give devise and dispose of it in ye manner following

Imprimis. I give of and bequeath unto my Beloved wife Lydia one third part of my real estate during her natural life and one third part of my personal estate forever. These I give as ye full of my widows dowre

Item. I give to my two sons William and Josiah Rogers all that farm of land on which they now dwell my son William to have ye western part and my son Josiah ye eastern, ye farm to be equally divided in (quantity?) and so much of farm as hath been sold off to Williams advantage to reckoned to my son Williams half; my son Josiah to have also all my undivided land at Waterbury I do hareby give ye abovesd lands to my above mentioned sons to them their heirs and assigns forever.

Item. I give to my sons Jonathan and Levy Rogers all that farm of land where they now dwell Jonathan to have ye Cedar Swamp and ye Cedar Swamp Lot adjoyning; and so much of ye Hill Lot and ye cove lot as to make up ye one half of ye whole; and I give to my son Levy ye other half, Levy to have his part on that side of ye farm where he dwells with ye buildings standing thereon; and my sd son Jonathan Rogers to have ye side of ye land where he dwell with ye buildings thereon the sd land to be to my sons to their heirs and assigns forever

ITEM I give and Bequeath unto my Son David all that land that I bought of Abraham Bertholomew lying in Branford with ye buildings thereon to him his Heirs and Assigns forever

ITEM I give anf bequeath unto my other two sons Thomas and Nehemiah Rogers all my farm at Bear Plain?9 where I now dwell Thomas to have West End of ye farm and three acres and half more than Nehemiah because I hereby givets my sd son Nehemiah that parcel of land over against my house which I bought of ____ and Ebenezer Barns--- ye Moreover I give to my sd son Nehemiah Rogers all my Right of Land that I bought in partnership with my brother Noah Rogers of our Brother Hezekiah Rogers lying in Branford at a place called Bare Hill; my sd son Nehemiah to have ye Cornmill and liberty to kepp up ye Dam and pond forever and also I give to my sd son Nehemiah my negro boy called Champy and also ye House and Barn where I now dwell; I also give to my sd son Thomas Rogers my Iron Works and all that belongs to it but all my Teem tackling I give to my Son Nehemiah ye sd Land above mentioned to be to my aforesd two Sons to them there heirs and asigns forever

ITEM I give to my youngest Daughter Eunis my negro Boy Simon; And in as much as whim (sic) my Daughter hath not already had so much out of my State as ye rest of my Daughters, I therefore give to her twenty pounds Lawful money to be paid out of my moveable Estates; and when my Lawful Debts and funeral expenses are paid out of my moveable estate; and what I have willed above out of it the Remains of my moveable Estate Shall be Equally Divided between my four Daughters Lydia Mary Sarah and Eunis and my granddaughter Abigail Foot ye wife of Abraham Foot.

ITEM I do also hereby Constitute appoint and ordain my sons above mentioned Josiah Rogers and Jonathan Rogers Executors of this my Last Will and Testament and Do hereby give all my Right of undivided Land in Branford to all my aforsd Sons Equally William Josiah Jonathan Levy David Thomas and Nehemiah Rogers, and if I have any Just right of Land either in possession or 9 not mentioned or willed above it is my will and pleasure that it be Disposed of in ye Payment of my Lawfull Debts Instead of ye whole comeing out of my moveables and I do hereby unterly Disallow Revoke and Disannul all and Every other former Wills Legacies bequests and Executions by me in any manner willed and made rattifying this and no other as my last will and testament; In Witness whereof I have hereunto Set my Hand and Seal in ye Day and year above written.

Then personally appeared ye Revd Mr Jonathan Merick Miner Merick & Jerusha Merick Junr ye above subscribed witness and made oath that they saw ye Testator of the above Instrument to be his Last will and Testament and that they signed as Witnesses In presence of the Testator Before me Jonathan Russell Jus Peace.
