Jacob Bennet, bapt. 29 December 1737, Dutch Reformed Church of Freehold-Middletown (wits: Cornelius Santvoort, Geertje de Hart) -- he is (probably the one who) died in 1811, Middletown, Monmouth County, NJ, weaver [Note 5]. He married Euphemia (Effie) Aumack, bapt. 17 August 1735, Dutch Reformed Church of Freehold-Middletown, daughter of Teunis Teunis Aumack and Lena Lane.

Jacob Bennet's will

In the name of God amen I Jacob Bennet weaver of Middletown in the County of Monmouth and State of New Jersey, being now in good health and of perfect mind and memory do therefore make and ordain this my last will and testament in manner following. My body I recommend to the Earth to be buried in a Cristain like decent manner at the discretion of my Executor herein after named Imprimis it is my will that first of all my just debts and funeral charges be paid out of my Estate if any then be after my decease and as to all the remainder part of my Estate both reale and personal whatsoever and wheresoever situate and being which I am now seised of intrusted in or instilled unto I give and bequeath unto my son namely Daniel Bennet to him, his heirs and assigns forever upon condition of his performance of paying the following legacies as they become due to the legates herein after named. Item I give and bequeath unto Effey my beloved wife the one equl half of all the produce raised on the said lot I now live on, also the use of one milk cow to be kept and supported by son Daniel also I give unto my wife Effey the use of all the remaining part of my personal Estate after my debts is paid during her natural life and after her decsees to be the property of my son Daniel also that my wife Effe have the use of the dwelling Hous that I now live in during her natural life and to be under the care and protection of my son Daniel. Item I give and bequeath unto my three sons Johones Bennet, Tunes Bennet and William Bennet the sum or amount of ninety dollars to be paid by my son Daniel Bennet in the following proportion share and share alike each to receive five dollars, six years after my wife Effey decease and at the expiration of two years each to receive five dollars and so to be paid every two years until the ninety dollars is fully paid by my son Daniel to them, their heirs and assigns forever, my will further is that if my son Tunis Bennet should not return to these parts to demand his equal part of the ninety dollars as above said then my son Daniel be released from the payment of any part of said Tunis Bennets share, except his the said Tunis Bents heirs or his order in that case the said Daniel Bennet is to pay the legacy so demanded. And Lastly I do hereby constitute ordain and appoint my bloved son Daniel Bennet to be my sole Executor of this my last will and testament and I do hereby revoke all former wills and testaments in any wise heretofore made, and do hereby declare this only to be my last will and testament. In witness whereof I have set my hand and seal this twelfth day of May, in the year of our Lord, one thousand eight hundred and ten 1810, Signed. The word will between the fourth and fifth line the word Estate between the thirteenth and fourteen line, the word will between the twenty second and twenty third line the word pay fifth and twenty sixth line was all underlined before the sealing and delivery of the same.

John Longstreet, one of the witnesses to the within will being duly sworn on the Holy Evangelists of Almighty God, did depose and say that he saw Jacob Bennet, the Testator there in named sign and seal the same, and heard him publish, pronounce and declare the within writing to be his last Will and Testament, that at the doing thereof the said Testator was of sound and disposing mind and memory as far as this Deponent knows and as he verily believes that Hendrick Hendrickson and Denise Hendrickson, the other subscribing witnesses were present at the same time, and signed their names as witnesses to the said Will, together with this Deponent, in the presence of the said Testator. Sworn at Freehold the 24th April 1811 - Before me John Longstreet W. (?) Throckmorton, Surrogate Daniel Bennett, the sole Executor in the within Tesament named, being duly sworn on the Holy Evangelists of Almighty God, did depose and say that the within Instrument contains the true last Will and Testament of Jacob Bennet, the Testator therein named, as far as he knows, and as he verily believes. That he will well and truly perform the same, by paying first the debts of the said deceased, and then the legacies in the said Testament specified, so far as the Goods, Chattels and credits of the said deceased can thereunto extend - that he will make and exhibit into the Surrogates office of the County of Monmouth a true and perfect Inventory of all and Singular the Goods, chattels and credits of the said deceased, as afar as have or shall come to his knowledge or possession, or the possession of any other person or persons for his use, and render a just and true account when hereunto lawfully required. The foregoing Will being proved, Probate was granted by me unto Daniel Bennet Sole Executor in the said will named, He being first duly Sworn well and truly to perform the same, exhibit a true and perfect inventory, and render a just and true account, when thereunto lawfully required; Given under the Surrogate Seal of the County of Monmouth, the day and year last above said.
