James Cargill's Will- October 27, 1753:

"To all people to whom these presants shall come. I, James Cargill, of Mendon in the county of Worcester in the providence of Massechusetts Bay in New England Clothier send greeting know yee that I the said James Cargill being in good health of body also of sound and well disposed mind and memory, thanks be therefor humbly offered unto God my great Creator through Jesus Christ my holy redemer and savior. But considering my age and the many infirmities ____________ thereto and the great uncertainty of my continuance in this life ________ take this opportunity to make and ordain this my Last will and testament, that is to say principally and first of all, I give and recommend my soul into the hands of God that gave it and my body I recommend to the Earth to be buried in a decent and Christian manner at the discretion of my executors hear after named ...

Item: I give and bequeath to my well beloved wife, Sarah (Aldrich) Cargill the best one of my beds and beding and what peuter she brought with her and futher I give my wife thirty pounds lawfull money to be paid out of my estate that is to say tenn pounds lawfull money within one year after my decease and twenty ponds lawfull money when my son, Benjamin Cargill is of age if she remain my widow otherwise if said wife shall choes (choose) to abide with my children. She shall be paid and agreeably maintained out of my estate during her natural life but if she be uneasy with this to have the sum above.

Item: I give and bequeath to my daughter, Mary Arnold, at my decease, one-third of all my household goods, pots, kettles, dishes, peuter and trammels and tenn pounds lawfull money when my son Benjamin comes to age.

Item: I give and bequeath to my daughter, Chloe Jilison, one-third of my household goods as pots, kettles, dishes, peuter, beding only what is mentioned (save?) any to my wife and tenn pounds lawfull money when my son, Benjamin, is of age and the household goods at my decease.

Item: I give and bequeath to my daughter, Lucy Cargill, one-third of all the household goods that I have so as to make her equall to her sisters: and tenn pounds lawfull money when Benjamin comes of age: and at my decease to have one cow and six sheep.

Item: I give, devise and bequeath to my two sones, James Cargill and Benjamin Cargill all and singular my reall estate both houses and lands to them and their heirs forever as an absolut estate of inheritance in feesimple to be divided equally betwixt them when Benjamin Cargill arrives at twenty-one years of age and because I have done more for my son James then I have done for Benjamin. I give my son Benjamin Cargill, my riding beast, sadle and bridle and all my Clothier tools and Loome and takling: whatsoever and to be left in the hands of Seth Arnold till he is of age, if it please God to remove him by death before he is of age, then all that I have given him is to be equally divided betwixt his brother and sisters, it is also my mind that the first legace to my wife be paid out of my notes and book debts and all the other legacies afore mentioned be out of my Reall Estate as before mentioned when my son Benjamin is of age. And also that Benjamin be brought up at the Clothing trade and some more scooling by my executors till he is of age, they allowing him keeping and clothing and a ________ ____ and fifty pounds old tenner (tender?) by the year till he is of age. And I do constitute, make and ordain the afore named Seth Arnold and James Cargill to be my sole executors of this my last will and testament...
