James was born in 1771. He passed away around 1828, and his estate was evaluated for probate in May 1828.

He appears to have had 5 children: James, Archibald, Matthew, Elizabeth and Sarah. Along with his widow, these would constitute his 6 heirs at law named in his probate papers. Will & Probate

James died intestate.

In his probate papers, a son James is named executor and the other Graham who appears in the division of property is a Robert Graham. (Possibly a brother?)

His wife is unnamed except as "the Widow," but she acquired a large division of the property including:

  • 2 barshear plow clvrs & singletree $150 ea.
  • 1 shovel plow $80
  • 1 side harrow $75
  • 1 matock $75
  • 1 falling ax $80
  • 1 hand saw $25
  • 1 pair streachers $150
  • 1 side saddle $2
  • 2 pair gears 2 bridles & collers $7

and

  • The House Track S??rd $[unc]
  • 1 Negroe Fellow Jack $105
  • 1 Negroe woman, Dorcas $300

and

  • 1 sorrel mare $77
  • 7 head geese
  • 3 lots of hogs
  • 1 brindle cow
  • 1 red spotted cow
  • 1 black heifer black face

This is a vast amount of money directed specifically toward acquiring farm land and those items, people, and livestock considered necessary for its profitable management at the time. This suggests that she intended to become a head of household (and likely had heirs to support), rather than moving in as a dependent of a relative, aligning with the widowed Margaret Graham who appears as a head-of-household at the 1830 census.

Along with items, $203 was paid from the estate to a Matthew Graham. Additionally, there's $114 paid "my legacy due me from my father's estate" signed [unc] A?d.M. Graham. $143 legacy to Elizabeth Jackson, signed on receipt by John Jackson.

The papers cite "His following children unto [unc] Viz. A?d. Grayham $118 Matthew Grayham $90 Elizabeth Jackson $49 Sarah Merret $20

Then "divided amongst 6 heirs at law."

Since the only family are son James Graham Jr. and Robert Graham (unknown relation) that appear purchasing items from the estate, along with John Jackson and Will Merrit (spouses of daughters Elizabeth and Sarah, presumably), we can guess that heirs A?d. Graham and Matthew Graham who are named were probably not yet established in their own household at the time of probate.
