James Rutherfoord, of that ilk, who, together with his brother Nichol, were appointed guarantees of a treaty with the English, anno 1449.
He got charters under the Great Seal, Jacobo Rutherfoord de eodem, of the lands of Leithbert, Leithbertshiels, and many others, in the years 1451-1452. He died soon after, leaving issue a son and successor, James.

Previous writers credited Sir Richard with five sons although only three appear in record. To disentangle errors in earlier stories these five men are listed in the order given in SP:
