About Jno Joseph william Maseret Courtoy

ID: I488 Name: Jno Joseph William Maseret COURTOY Given Name: Jno Joseph Surname: Courtoy Sex: M Note: There is some suggestion that William is aka William Jerkins and fathered children with Eliza Sewell Flitt - the wife of his son George. This appears to be at best some romantic notion as the evidence provided by certain key dates do not lead to that conclusion:

William Jerkins/Jarkins witnessed baptism of Agnes in November 1838 in Adelaide; William Courtoy witnessed the death of his son William on 18 August 1838 and then registered the death on 21st August at Bromley, London. The trip to South Australia frequently took 4 months.

William Jerkins is found in 1841 census of Adelaide (1st January) with Eliza and children; William Courtoy is at Church Street, Forest Gate on 6 June 1841. William Courtoy found in 1851 census (on 30 March) at 12, Lion Street, Poplar, London whilst there are various entries for William Jerkins early in the New Year of 1851 in the Government Gazette.

William Courtoy was also at Church Street, Forest Gate for the death of his wife on 26 March 1846 and the registration of that death on 3 April. If the claims that William Courtoy aka Jerkins is one and the same then he must have been a regular traveller between England and South Australia - not a trip taken lightly in the mid 19th Century. It is doubtful that William Courtoy ever left England.

Searched West Ham Electoral Register 1845/6 - no entry for Courtoy. The Law Journal for the Year 1832-1949: Michaelmas 1851 to Michaelmas 1852: Vol: XXI: Page 292. Courtoy v Vincent. John Courtoy, in his will of 28th May 1814 left certain amounts in investments in order to pay annuities - some of these to the children of William Courtoy after the death of his brother George in 1848. Frederick Courtoy, with his regiment in India, was unable to personally take receipt of his share (some GBP589-6-6) which was received by his father William Courtoy under the terms of a power of attourney. William Courtoy only paid GBP70 over to Frederick who then bought an action against his father in the Court of Common Pleas. On 22nd December 1851 final judgement was made in the sum of GBP519-6-6 plus costs of GBP9-5-5. The Sheriff of Middlesex was unable to recover the amount from any properties so made an order against the payment to William of the annuity. This case reversed that claim on the basis that the annuity was payable to William and not transferrable or otherwise assignable.

Some father!
