STAFFORD COUNTY VA WILL BOOK M; 1729-1748; THE ANTIENT PRESS pp 362-363 In Name of God Amen I JOHN WAUGH of County of Stafford in Parish of Overwharton being Sick do make this my Last will and Testament in manner as followeth Vizt First I give my soul to god, next I leave my body to earth. Item I give unto JOHN AND THOMAS MONK all Mv land in Prince William County on the branches and run of Popeshead and Johnemore to them and their heirs to be Equally devided between them and heirs of their bodies lawfully begotten and for want of such heirs I lease it to PRISCILLA MONK and heirs of her body. Item I give unto Prissilla Monk all that land on South side of Occoquon at the Fork of her and heirs and for want of such heirs I leave to John and Thomas Monk to be equally divided between them to their heirs. Item I give unto MARY WAUGH LUNSFORD all my land adjoining to the Glebe between Potomack and Accokeek Runs to her and her heirs and for want of heirs I leave it to PRISCILLA HAY and her heirs. Item my desire is that what little Personal Estate it bath pleased almighty to bestow upon me I leave it to be kept together for the support of the three children John, Thomas and Priscilla, Supposing they all continue together Likewise all my Rents to be in the same manner disposed of only 500 pounds of Tobacco to be paid out of my rents towards the support of MARY WAUCH LUNSFORD for five years, and after the 5th year 1000 pounds of Tobacco yearly tell she has got the Land left her in my will in possession. Item I give unto SARAH CHADWELL daughter of GEORGE CHADWELL if the said George should have no son but if he have a son then to his son 2000 pounds of Tobacco and Five pounds current money to be paid when she or he arrive to the age of 21 years. And likewise to BRYANT CHADWELL Son of WM. CHADWELL the same sum of money and tobacco when he comes to age of 21 years. Item I give unto WILLIAM CHADWELL Son of Bryant Chadwell 2000 pounds of Tobacco and five pounds current to money to be paid unto him when he arrives to 21 years of age. Item I give unto MEALY WHITECOTTEN Son of SARAH WHITE COTTEN 2000 pounds of Tobacco and Five pounds current money to be paid when he shall arrive to age of 21 years. Item I give unto THOMAS CONWAY 450 pounds of Tobacco to be paid in June in the year 1744. Item it is my desire that ELISABETH MONK Mother of JOHN, THOMAS and PRISSILLA MONK stay with them and have the looking after and bringing them up during the time her good behaviour and unmarried if she misbehave or marry, it is my desire she stay no longer. Beginning at a White Oak pages 278-280 4 WAUGH, DAVID 600 24 September 1710 NN 3:270 North side Occoquan, upper side of Popeshead. David Waugh sold to Capt. Henry Connor (Conyers) who by will devised 300 acres to daughter Anne Holand and residue to daughter Theodosia who married James Deneal. Deneal, or Deneale, found surplus of 252 acres and received a NN grant for 552 acres. (NN I:210) Anne Roland married Edward Payne who sold her half of patent 24 May 1785 to David Stuart. This was part of tract of 1250 acres acquired by Ed. Payne. The entire tract sold for £3100 current money of Virginia. (Fx. Deeds Q:145)

Beginning at a White Oak pages 278-280 34 WAUGH, JOHN JR. 298 26 July 1706 NN 3:132 Main Run of Tillett's Creek.* John Waugh sold this tract to John Peake. John Peake's will, dated 16 November 1728, is missing, but his son, William, in his will dated 11 January 1761 devised to daughter Sarah 114 acres, "being part of a tract which my father bought of John Waugh." (Fx. Wills B:247-50) This land is otherwise described as being two miles north of Colchester and one and one-half miles from Occoquan Mills.

This land was divided 17 September 1735 between the sons of John Waugh, Sr.: John Waugh, Jr. took the upper portion, William Waugh took the middle portion and James Waugh took the lower portion. (Pr. Wm. Deeds B:196)

Alexander Waugh, agent and attorney for Lewis T. Waugh, sold for $2000 to Anne Alexander B. Waugh 520 acres purchased by Lewis T. Waugh of the heirs of James Waugh. (Fx. Deeds B3:210. 24 July 1834)

Tyler Waugh, son of William, and Mary his wife sold for £550 current money of Virginia 933 acres to John Gibson. (Fx. Deeds M:254. 27 December 1776) Tyler Waugh excepted Peter Turley's lease of 250 acres and 250 acres sold Pricilla and Peter Mauzy.

John Waugh of Stafford County (John Waugh, Jr.) by his last will and testament 6 November 1742 devised unto John and Thomas Monk his lands in Prince William County lying on the branches and runs of Popeshead and Johnny-more. Thomas Monk and Margaret his wife sold 8 September 1762 to Paul Turley 450 acres. Paul Turley devised unto his sons Ignatius, John and Paul. Ignatius Turley and Rachel his wife sold 110 acres 17 March 1777 to Edward Payne. Sarah Turley, widow of Paul, and John and Paul Turley sold 24 March 1777 to Alexander Henderson for £295 current money of Virginia 295 acres. John Turley had sold 45 acres to Edward Payne before 24 March 1777. (Fx. Deeds M:290 and L:243)

John Monk of Newberry County, South Carolina, sold 520 acres to Sampson Turley beginning at dividing line of John and William Waugh for £150 current money 3 November 1765. (Fx. Deeds Q:503. 4 July 1786. Confirmation of earlier sale.) Sampson Turley and Martha his wife sold 40 acres to John Gibson 21 August 1786. (Fx. Deeds U:77) Sampson Turley and Martha his wife and James Turley and Anne his wife sold 419 acres for £755 to Lewis Pritchard 15 February 1800. (Fx. Deeds B2:511]

I do make this my Last Will and Testament in manner form following making void all other Wills .. Imprimis .. My soul to God .. I give to my dear loving Wife BETTY WAUGH the plantation whereon I now live & all the lands adjoyning to it that belonged to my Brother JOHN WAUGH & five negroes (named) during her widowhood & if my wife should marry it is my desire that my son JOHN should have the land and the negroes to be disposed of in manner following. If my wife should now be with child that the negroes be equally divided between my Daughter SARAH WAUGH & it and if my wife should not be with child that then my desire is that my wife shall deliver up the negro wench Pleasant & her Increase and Moses to my Daughter Sarah at the time of her marriage or at the time she shall arrive to the age of 18 years & the rest of the negroes to be to my Daughter Sarah after my Wife's death. Imprs. I give to my loving son John Waugh all my land in Stafford County after the marriage or death of my Wife afsd to him & the male heirs of his body forever, for want of such heirs to my son JAMES WAUGH & his male heirs. Impr. I give to my son James all my lands in Fairfax County to him and his male heirs .. want of such heirs to my son John Waugh further if neither of my sons shall have Male heirs then my desire is that the land in Stafford County I have left my son John Waugh should descend after his death to his oldest Female and the land I have given to my son James Waugh to his Eldest Female and if neither of my sons have issue it shall descend to the next heir at Law. Imprs I give to the ExEr of WILLIAM WISE it being 47 Pounds it being the Ballance of his account against me to he appropriated as the rest of his Estate & to be paid by my Exrs. in the year 1751 there being no perfect amount left by the said Wise against me. Imps. I appoint my Loving Wife and Friends Mr. JOHN MERCER, the Revd. JOHN MONCURE, Capt. GERRARD F0WKE, & Mr. JOHN HAMILTON Exrs of this my last Will and Testament and its further my desire that Mr. John Mercer and the Revd. Prince William County, Virginia Deeds {June Whitehurst Johnson}: Liber A; 1731 - 1732 Pages 311-316. Aug. 15, 1732. David Waugh of Parish of Overwharton in Stafford, planter and Priscella Hays of same, widow executor of last will and testament of John Waugh, surviving executor, and John Waugh son and heir of the said John Waugh dec. to Alexander Scott of same....granted to John Waugh by Proprietors on. Feb. 25, 1709....1025 a. on Wolf Run....and John Waugh made his last will in writing dated Oct. 8, 1716 and directed the said land be sold by his executors in these words following, it is my will and meaning that my lotts in the Town of Marlborough be sold for good of my children.... appoint his executors Joseph Waugh, Alexander Waugh and said David Waugh and Priscella Hay (then Priscella Vandegostell) and recorded among the records of Stafford Co....whereas Alexander Waugh one of the executors died soon after the said John Waugh....afterwards the said Joseph Waugh, David Waugh, and Priscella Hay by their deeds of lease and release dated 11/12 of Sept. 1723.....for 1000 lbs. of Tob. and 5 shillings sterl. sell to Alexander Scott the said land... John Waugh then an infant under the age of twenty-one, would as soon as he should arrive to full age sign seal execute and deliver unto the Alexander Scott such deed or deeds as should be sufficient to comfirme a perfect estate in fee simple....Joseph Waugh since departed this life and David Waugh and Priscella Hays are the only surviving executors...John Waugh eldest son of John Waugh has now arrived at full age of 21.

John Waugh of Parish of Overwharton in Co. of Stafford, planter to James Waugh of same and William Waugh of same.....John Waugh late of said Parish and Co., Gent. decd father of them said John, James, and William, being in his life time seized in his demisne as of fee of and in several missuages lands....one tract containing 1200a upon head of Patowmack Run in Stafford and King George granted by one Joseph Waugh dec. to John Waugh dec.....one other tract of 523 a. on Occoquon River above the falls at the run called North Run in Stafford Co.....one other tract of 602 a. on north side of Occoquon River upon Wolf Run.... near the Indian path....corner of 902 a. of land belonging to Robert Carter Esq. ....John Waugh the father did by his last will at Oct. 8, 1716 give unto his son William Waugh 600 a. part of the above mentioned tract of 1200 a. upon the head of Patowmack Run and by his will devises the residue of the said 1200 a. and of the other two tracts of land above mentioned and his son Thomas Waugh (brother of the said John, James, and William) 600 a. part of tract of 1200 a. upon the head of Patowmack adjoining to land which I gave to my son William Waugh and granted to me by my brother oseph Waugh....Thomas Waugh shall have all my lands in the fork of Occoquon being 528 a. and also give unto my son Thomas Waugh 606 a. upon east and west of Wolf Run....Thomas Waugh is since dead without issue as the several lands and revert to said John, James, and William and agreed that said premisses shall be equally divided....partition as follows ....John Waugh shall have 525 a. on Occoquon River above the falls called North. Run granted to John Waugh dec Sept. 20, 1710....James Waugh shall have 602 a. on north side of Occoquon River upon Wolf Run near mouth thereof granted to John Waugh Feb. 24, 1709.... William Waugh to have 600 a. being northermost part of 1200 a. on head of Patowmack Cr. which was granted to John Waugh dec. by his brother Joseph. Signed John Waugh, James Waugh, William Waugh Wit: John Awbrey, Peter Mauzy, Tho. Owsley, Tho. Pearson. At court March 20, 1733 this deed of partition between John Waugh, James Waugh, and William Waugh was acknowledged by said parties.

Wm., planter....for 8000 lbs. of Tob.....90 a. in the fork of North Run of Occoquan River above falls....being part of a greater tract of 525 a. granted by Proprietors to John Waugh, Gent father of said Jonn Waugh, by deed dated Feb. 4, 1709....deed of lease and release. John Waugh Wit: John Turley, George Foster, Job Carter, and Benj. Tyler. Rec'd of Maurice Veale sum of 8000 lbs. of Tob. March 20, 1733. At court March 20, 1733 John Waugh acknowledged this release with receipt endorsed to Maurice Veale.
