About Marion Tulloch

MARION TULLOCH (aka MARION TULLOCHE or MARION TULLOCHT)

Marion Tulloch's parents have not been identified. On 16 October 1620 she and her husband had a charter by which James Tulloch of Ness gave them one half of the room and lands of Ness in the parish of Saint Andrew, together with other lands in Shapinsay, Birsay, Firth, and Kirkwall, and the fact of this suggests that Marion Tulloch was James's mother. Death

Marion Tulloch married Arthur Sinclair, merchant in Kirkwall. The Moodie Book They were married before 12 June 1618, the date upon which she and her husband had a charter from Adam Bellenden of Stenness for an annualrent of 24 meills malt to be uplifted from the lands of Burgar in the parish of Evie. They had another charter from him for an eight penny land in Burgar on 29 June 1618. Orkney and Shetland Records II Marion Tulloch's second husband died in March 1622. Marion gave up his testament dative and the inventory of his moveable estate in name and behalf of their daughters Euphame Sinclair, Marie Sinclair, and Margaret Sinclair. Marion Tulloch married Francis Mudie of Breckness. The Moodie Book She is identified as the relict of the deceased Arthur Sinclair in a deed dated 30 July 1624 but she married Francis Mudie of Breckness before 1 December 1625, the date upon which she had a charter by which her husband confirmed that he had given her a liferent of the rooms and lands of Breckness.National Records of Scotland, Papers of the Scarth Family of Breckness, Orkney, reference GD217/60

Petition for Divorce

On 22 November 1627 Marion Tulloch petitioned the Archbishop of St, Andrews for a divorce from her second husband Francis Mudie of Melsetter: "for the cryme and fact of adulterie comittit be him wt Katherein Nicoll ..... at divers tymes sen our marriage quha hes borne to him in adulterie ane sone James Mwdy yett liveand." Marion Tulloch's son Edward Sinclair, merchant in Kirkwall was one of the witnesses to the petition. [Orkney Archives, Orkney Library and Archive, Kirkwall, George W. Evidence from the Orkney Sasine Register

On 16 October 1620 James Tulloch of Ness gave one half of his room and lands of Ness to Arthur Sinclair and his wife Marion Tulloch, together with various other lands in Shapinsay, Birsay, Firth and Kirkwall, all in Orkney.
