LAST WILL AND TESTAMENT, MARY RICHBOURG GAYLE (#47, p.16)

STATE OF MISSISSIPPI, AMITE COUNTY:

I , Mary Gayle of the State and County aforesaid, being of sound and disposing mind, do make and publish this my last Will and Testament.

I give and bequeath to my daughter, Sarah E. Caulfield, a certain negro boy named Wade, together with a feather bed and furniture for the same, and the tract or quarter-section of land and appurtenances thereunto belonging on which I now reside.

I give and bequeath to my son, Richard C. Gayle, a certain negro named Milly , one feather bed and furniture for the same during his natural life , and should he have issue by his present wife or by any other legal marriage which he may hereafter contract, it is my wish and desire that said property go to his legal issue, provided, however, i f none of these circumstances should occur, it is mydesire that said property be equally divided between my other children who at that time may be living . I give and bequeath to my son, James R. Gayle, certain negroes, namely, July, Sam and Adam, and bed and furniture for the same, and secretary.

I give and bequeath to my son, Laurence G. Gayle, certain negroes, namely, Dave and Leah, one bed and furniture for the same, one mule called Doll , together with all my lands with the exception of that parcel or quarter-section given to my daughter, Sarah E. Caulfield , as herein mentioned.

I give and bequeath to my granddaughter, Mary Conway, a certain negro named Amelia, and should she, Amelia, have issue i t i s my desire that the firs t bom go to her sister , Sarah Conway, provided, however, i f either or both of the above named grandchildren, namely Mary and Sarah, die without legal issue it is my desire that the above named negro and her issue be divided equally between the surviving full brothers and sisters of the said Mary and Sarah.

I give and bequeath to my granddaughter, Mary R. Gayle, daughter of James R. Gayle, a certain negro named Gereak. Should the said Mary die without legal issue, said negro with her increase and issue, if any, I desire to go to James R. Gayle, Mary's father.

I give and bequeath to my grandson, Horace Ridder, son of my daughter, Emily S. Johnson, three certain negroes, namely: Rachael, Gano and Amanda; one feather bed and matress; four sheets, two blankets, two bed quilts , four pillow cases, two pillows, one high post bedstead - the one purchased at Bayou Sara - eighty bushels of com, one large stack fodder, and eight hogs such as are suitable for making bacon, commonly called meat bogs; provided, however, if the said Horace should die without legal issue, it is my desire that all the property given and bequeathed to the above Horace, as above stated, go to his mother, Emily S. Johnson, and it is further my wish and desire that no charge or claim be made against the said Horace for board, clothing, schooling, or any other thing during his residence with me to be paid out of said property given to the said Horace, and that this property shall be a free gift.

It is my wish and desire that the children of the said Richard C. Gayle by his former marriage with Sarah McGehee in said county and state aforesaid, shal l not receive or enjoy any part or parcel of my estate, either real or personal, which I now or may hereafter possess.

Made and published under my hand and seal this 28th day of January, i n the year of our Lord, one thousand eight hundred and fifty-six , i n the presence of William G. Johnson, Tarrot Gaston and David Pemble, who have hereunto subscribed as witnesses, etc.
