State of Georgia, Morgan County

In the name of God – Amen

I Mary A. Shephard of the County and State aforesaid being weak in body but of a sound mind, memory and understanding and considering the certainty of death and the uncertainty of the time thereof and to the end I may be the better prepared to leave this world whenever it shall please God to call me hince do therefore revoking all other make and declare this to be my last will and testament in names following

Item 1st I commit my soul into the hands of my Creator who gave and my body to the earth to be interred in a decent Christian like manner. The expenses to be paid out of my Estate.

Item 2nd It is my will and desire that my Daughter Matilda M Perkins wife of Walker P Perkins Share equally with my other children in my Estate. Should they return certain negroes to wit the woman Louisa and her five children and increase to my estate. To be divided equally with all my children but in case my said son in law Walker P Perkins and his wife my Daughter Matilda M fail to return as above stated that is my will that they shall receive nothing whatever of my estate as left to me by my Deceased husband Thomas J Shephard .

Item 3rd I further will that a sufficient amount of my Estate be held in reserve to give my two minor children William O and Odonnel J a Country support and education such as my other children have received.

Item 4th It is my will that in Case any of my children die leaving no issue of their body the property which I leave to them shall be returned to my estate and divided equally between my surviving children and if any be dead leaving a child or children then said child or children being my grand children shall take the part which the deceased Parent would taken if living.

Item 5th I give to my Daughter Sarah LV Allmand a negro woman name Binney valued by me in 1859 at one thousand dollars which negro woman I have placed in her possession and I appoint her husband Calvin R Allman – Trustee for my said Daughter Sarah LV Allmand. I give also to my Daughter Sarah LV Allmand the negro girl Sarah about eight years old extra to be held in trust for her sole use & benefit by her husband Calvin R Allmand.

Item 6th I give to my son Carter A Shephard six hundred and sixty-four dollars and one hundred and thirty Dollars in property making in all Eight hundred dollars which I have heretofore placed in his hands.

Item 7th It is my will that my Daughter Mary A Shephard receive the girl Jane mulatto complexion about twenty seven years of age and her son Ned about four years of age and their increase extra then to share equally with my other children.

Item 8th I further will to each of my minor children a bed and furniture such as my other children have received. And should there not be enough of such property in my Estate then the same to be advanced in money.

Item 9th It is my will that all my children share equally in property with my Daughter Sarah LV Allmand then to share and share alike of the remaining except as heretofore excepted in Item nos. two, five and seven.

Item 10th I nominate and appoint my friends Dr. Hugh L Oglesby and Joel C Barnett Executors to this my last will and testament and give them power to sell lands and negroes and such other property as they amy deem best for the interest of my Estate and invest the proceeds ther of in other property with the concurrence of the Court of Ordinary – I testimony where of I have hereunto set my hand and seal this the 17th day of January 1864
