Defendants appealed from lower Court Order requiring both Defendants to sell or remove all buildings, improvements and chattel property from the real property of the Plaintiff obtained from a decree of divorcement from Russell County dated 14 Feb. 1817
Nancy Ferrell wife of Richard Ferrell of Tazewell County lately divorced from the Defendant Samuel Taylor under oath deposed and said that her father Michael Sword gave her the land where Samuel Taylor now resides but no deed was recorded so the lower Court awarded her the 166 acres located on Cedar Creek by the James Jackson property.In the divorcement proceedings a Mary Preice who at that time was a live in companion of the said Samuel Taylor was awarded the house she lived in on that same property during her lifetime later to be given to the heirs of Nancy Sword Taylor.Mary (Polly) Preice still resides in that house and the Plaintiff has no objections to her staying there until further arrangements can be made for her removal to other housing.Samuel Taylor has since remarried to Nancy an Hier of Jesse Vermillion and refuses to vacate the premises and Plaintiff states that he has been charged with bigamy by the Russell County Court at Lebanon.Nancy also states that she wants Samuel Taylor her former husband and all his co-ha biting companions, Indians, and step and bastard children removed from the property and the Court decree encored

Defendant Samuel Taylor under oath deposes and states that he built houses, farmed the land for 12 years, and constructed many improvements for his wives and he therefore wishes not to be removed from the property and does not wish to sell the improvements.
Defendant Mary Preece under oath deposes and states that she has no other house to live in at the present time and sees no reason to move since her child was fathered by Samuel Taylor after a proper marriage ceremony after the order of the Cherokee Nation.
LOWER COURT RULING UPHELD..........WRIT OF EXECUTION ISSUED

Mary Price (Preese) , was a Cherokee Indian.Her Indian name was, Mary TA-KE-LA-NOWE.She was born in 1760 in Harlan County, Kentucky.Apparently she had been adopted by Daniel Price when she was a child.He migrated from Cherans District, South Carolina, to Virginia in 1781.Then to Harlan County, Kentucky.Mary was the widow of James Jackson.Her and Samuel were married June 11 1804. They had two children.
