Know all men by these presents, that whereas some years since our honoured ffather mr Moses Maverick of Marble-head deceased Intestate, and Administration of the estate amounting by Inventory to the value of three hundred forty two pounds & 19s was comitted to his Relict widdow Eunice Maverick, for the discharging of the Debts, ffunerall charges &c due from the sd estate, and ffinding most, if not all cleared and paid, and designing an amicable agreement may be kept and maintained amongst the children and such as Legally represent them, to whom any part of what is left may belong, as also a creditable and comfortable maintenance for his above sd Relict Widdow and ffinding the housing much decayed, and in a ruinous condition, We whose names are here subscribed, being all the children and grand-children of the sd Moses Maverick, and capable legally to act, and named as followes; Archebald ffurgeson Trustee for and in behalfe of his children by Mary his wife deceased; John Norman husband to Sarah the onely surviving daughter of the sd Maverick, & Moses Hawks the onely son of Rebecca the eldest daughter deceased for himselfe, and in behalfe also of Wm Hughes & Thomas Jackson marryed to Elizabeth and Priscilla Grafton, children of Elizabeth Grafton deceased, and by their Order impowred in this affair; Samuel Ward in behalfe of himselfe and his two sisters living and the children of his third and fourth sister deceased, descending ffrom Abigail Ward deceased; and Thomas Perkins marryed to Remember Woodman in behalfe of himselfe and all the Bretheren, children of Remember Woodman deceased; We above named doe consent, and mutually agree, that for the Ends abovesd, The whole estate now left, both Reall and personall, any of which may of right belong to us, be sold, and converted into money, and that after the paying of what just debt may yet be found due from the sd estate, the third part of the sd money be given freely to our hono[ur]ed aged mother Eunice Maverick, for her comfortable [maintenance and subsistence to improve and make use of as she shall see fit, and that the other two thirds be divided equally into six equall parts, and the persons above named may have and enjoy the same equally according to their degree of Relation, and persons whom they represent, Moses Hawks one sixt for himselfe Samuell Ward for himselfe and sisters a sixt, and so as above expressed; And we do ffarther Agree that Moses Hawks and Archebald ffurgeson shall have, and by this Instrument receive full power and authority to make sale of all the sd houses and lands of our deceased ffather, and by vertue of this power shall have liberty, in six moneths or as soon as maybe convenient, and according to instructions from us, To make such Deeds and Conveyances in due forme, in our behalfe, as may give a sufficient Title to any Purchaser whatever, Their own necessary charges to be deducted from the whole; In Testimony of all which, we the abovenamed, for ourselves Heirs, Executors and persons whom we represent, have for the confirmation of this Agreement sett our hands and seals with the consent of our mother also this 29th of Novemb Anno Dom 1698 .
