    • Ngwenya appeared in court on Friday 7th December 2022. He was released on bail in January 2022 after he was refused bail. The deceased's family was apparently not informed of his bail and, and furthermore, had heard that the charge of murder against him had been withdrawn, after the dossier had apparently disappeared.
    • According to the prosecutor of the National Prosecuting Authority (NPA), the state does not currently know where the accused is. Phyllis Vorster, prosecutor at AfriForum's private prosecution unit, said that Ngwenya received bail under peculiar circumstances.
    • AfriForum's private prosecution unit is acting in terms of a vigilance assignment on behalf of Roberto's wife, Cindy da Silva, who asked the unit for assistance when she heard earlier this year that the accused had been released on bail and that the NPA was no longer going to prosecute him for murder. This is despite footage indicating that Ngwenya had broken into the restaurant twice before and robbed cash. "During the third robbery, Roberto was shot dead," said Vorster. The civil rights organisation has committed to assisting Cindy by locating Ngwenya, and if necessary, having him extradited from Zimbabwe to South Africa.
    • According to Vorster, it emerged from this investigation that the accused submitted a bail appeal during the festive season in December last year and was released on bail in January this year based on "new facts". They made representation to the Director of Public Prosecutions in Gauteng (DPO) that the charge of murder should be reinstated and also made evidence material available to the NPA. After that, the NPA again decided to institute prosecution and the dossier was simply "found".
