Samuel's will and resulting action (from the Wildey book with paragraph punctuation added for clarity):

"In the name of God Amen the 5 day of January 1740/1, I Samuel Chesebrough of Stonington, in the County of New

London being sick and weak in body but of perfect mind and memory, thanks be given to God, therefor calling to

mind the mortality of my body and knowing that it is certainly appointed for all men once to die, do make and ordain

this my last Will and Testament, that is to say principally and first of all I give and recommend my soul into the

hands of God that gave it when it shall please him to call for it, and my body I recommend to the earth to be

buryed in decent and Christian manner, nothing doubting but at the general resurrection I shall receive the same

again by the almighty power of God, and as touching such worldly goods and estate wherewith it hath pleased

God to bless me in this life, I give, demise, and dispose of the same in the following manner and form.

Imp. I give to my two sons Charles and William Chesebrough all my lands and right of lands and buildings,

Orchards and fencing in Stonington, to be divided equally between them, when they all come to age of Twenty

one years, to be to them, their heirs and assigns forever, unless either of them should die without issue---but if

either of my sons should die without issue then I give to the survivor all my aforementioned lands, to be to him,

his heirs and assigns forever, excepting the house and building and ten acres of land I bought of the Rev. Mr.

Ebenezer Rossiter which I order to be sold by my executor hereafter named, and the money for which it is sold to

be put to Interest for the benefit of my two daughters Anne and Phebe.

Item -- I give to my two daughters Anne and Phebe Chesebrough Five Hundred pounds apiece to be paid to them

when they shall come to the age of Twenty years, to be paid to them by my executors hereafter named, in

Household goods as they shall be prized so far as they will go and the remainder to be paid to them in bills of

credit, and in case either of my daughters should die before they come to age of twenty years and without issue,

then my will is the other should have her part and portion here given her.

Item -- I give twenty Pounds in bills of credit to and for the further finishing the meeting house in the east Society,

in said town to be paid in some convenient time by my executors.

Item -- I give all my remaining part of my estate, after my funeral charges, Just debts and legacies are paid to be

divided equally between my four Children, namely Charles, William, Anna and Phebe. (note that the will spells

his daughter's name Anne earlier and below but Anna here)

Item -- I give to my two daughters Anne and Phebe all my decd Wife's wearing apparel to be divided equally

between them.

Item -- In case my children all die before they should come to age and without issue, then I give my whole estate

to my three brothers---namely Jeremiah, Jonathan and Joseph, Chesebrough, they paying to my sister Mary

Palmer Two Hundred Pounds in bills of credit to be to them and their heirs.

Lastly I ordain, make, and appoint my loving brothers Jeremiah and Joseph Chesebrough my Exrs to this my

last will and Testament: Giving unto them full power to sell the house and buildings and the ten acres of land

I bought of the Revd Mr. Ebenr Rossiter hereby ratifying this to be my last Will and Testament utterly revoking

and disannulling all other wills and executors whatever by me made or named and in further confirmation of this

my last will and testament I have hereunto set my hand and seal the day and year first above written.
