The Deposition of CONSTANCE PAIN of County of King George .. aged 63 years or thereabouts .. This Deponent Saith that she knew JAMES KAY SENR. and WILLIAM KAY his Brother that they were always reputed to be Lancashire men and that JAMES KAY was the Elder and that the said JAMES KAY married with one SARAH COLSON and had issue by her ffive children (to wit) JAMES, ROBERT, ANN, WILLIAM and RICHARD and that James was the Eldest and this Deponent further saith that the said JAMES KAY who is the Eldest and only Son now living of the said JAMES KAY the Son and inherited all the lands which his said father Dyed possessed of in this Colony and this Deponent further saith that she was in the Room when the said JAMES KAY the Grandson was born and further this Deponent saith not ..

The Deposition of EDWARD TAYLER of the County of King George aged 80 years or thereabouts .. This Deponent sayeth that he knew JAMES KAY and WILLIAM KAY two Brothers who were reputed to be Lancashire men and that JAMES was the Elder and Intermarryed with one SARAH GOLSON by whom he had issue five children (to wit) JAMES, ROBERT, ANN, WILLIAM, RICHARD .. of which JAMES was the Eldest and the said JAMES KAY the Son Intermarryed with one MARY PANNELL and had issue by her several children of which JAMES was his Eldest Son who is now living in County of King George .. and Inherits all his said father's land within this Colony and further this deponent saith not.

Deposition recorded 2nd September 1726 .. presented into Court by JAMES KAY and said EDWARD made oath in open Court to the Truth .. at Instance of JAMES MARKHAM is admitted to record.
