SIR JOHN HAMILTON OF TRABROUN

Sir John Hamilton of Trabroun is the son of Thomas Hamilton, first Earl of Haddington, and his second wife, Margaret Foulis. He was born on 3 November 1605. The Scots Peerage IV: 314

20 July 1621: (Extract) Marriage Contract between Thomas, earl of Melros, Lord Byres and Bineing, president of the College of Justice and secretary to the King, and John Hammilton of Trabroun, his third lawful son, with consent of Sir Andrew Hammiltoun of Reidhous, knight, one of the senators of the College of Justice, Sir James Foulles of Coleintoun, Mr. Patrick Hammiltoun of Prestoun, and George Foulles, master coiner to the King, his curators, on the one part, and Mr. Alexander Peibles of Skirling, advocate, and Agnes McKartney, his spouse, and Katherine Peibles, their only daughter, containing procuratories of resignation of said John Hammiltoun's lands of Trabroun in Berwickshire and of said Alexander Peible's lands and barony of Skirling and others for new infeftment in favour of the intended spouses (said John and Katherine) under reservation of the liferents specified. 3 July 1629: Crown Charter of Resignation following on a procuratory of resignation by said Sir John Hammiltone of Trabroun and his spouse, in favour of Thomas, their eldest lawful son, under reversion to said Sir John, of the lands of Trabroun and the lands and barony of Skirling, 3 July, 1629

Note: This charter was published in full in RMS VIII: 1437 Previous to the sale to Hamilton of Broomhill, Trabroun appears to have appointed his son to the succession under reversion but the latter died infeft in the lands and the impediment in the title was not observed until after the sale by Mr. John Hamilton to Mr. James Livingstone (see GD89/1/84, 91, 95)

6 February 1649: Extract marriage contract dated 27 November 1639 between Mr Laurence Rollock [Rollo], third son of Sir Andrew Rollok [Rollo] of Duncrub, and Katherine Peblis [Peebles], daughter of Alexander Peblis [Peebles] of Chappelhill and deceased Elizabeth Gaw [Gall], his spouse, with consent of her said father; whereby the parties agreed to marry and the said Mr Laurence Rollok and with him Sir James Rollok [Rollo], fiar of Duncrub, his brother-german, bound themselves to lay out upon land or annualrents the sum of 8,000 merks for behoof of the future spouses, survivor and heirs, with the advice of the said Alexander Peblis and, failing him, with the advice of Lady Katherine Peblis [Peebles], widow of Sir John Hamyltoune [Hamilton] of Trabroun, and William Bonnare [Bonar] of Keltie [Kelty], and the said Laurence Rollik bound himself to lay out the money received from Alexander Peblis by way of tocher upon lands or annualrent for behoof of himself and his future spouse, survivor and heirs; and on the other part the said Alexander Peblis of Chappellhill bound himself to pay a certain sum [blank] by way of tocher, to the said Mr Laurence Rollok reserving the annualrent thereof to himself during his lifetime; and the said Katharine Peblis bound herself to resign certain heritages, to which she succeeded on the death of Elizabeth Gaw her mother and her sister, for new infeftments in favour of her future spouse and herself, and to assign certain sums of money, to which she had succeeded, to the said Mr Laurence to be laid out on lands and annualrents for their behoof, and provision was made that if there were children of the marriage the said Katharine should have a right of liferent only to the said lands and sums of money pertaining to her, provided to her by her father, and to which she succeeded by the death of her mother and sister, together with the annualrent of the sum of 3,000 merks provied by the said Mr Laurence from his own estate; and that, if there were no children, Katharine should have right of liferent to all the above sums provided by herself and Mr Laurence, and to leave the sum of 3,500 merks to whomsoever she pleased during her lifetime after the death of her future spouse.
