Theophilus died intestate. The letters of adminisration filed 16 Dec. 1863 show Emeline Wilder, wife of Christopher C. Wilder and Stratton Ivory of Henderson, and Franklin H. Ivory of Adams and John W. Ivory of Henderson of full age and Theodore H. Ivory, Dewitt C. Ivory and Harrison Ivory of Henderson as minors. The laws of New York provided his wife Julia Knapp with the houshold goods and ten sheep, one cow, two swine and the meat of two swine. His inventory which included all the farm equipment and some of the livestock was valued at $5911.85 from which debts including the mortgage were paid, with a balance of $229.07 left to distribute to the heirs.
Ross Scot was appointed guardian of Harrison Ivory, minor child dated 24 April, 1868.
