About William Martin

Son of Col Charles Martin. DOB Unknown but assumed to be about 1759 or as late as 1764, perhaps in Loudoun County Virginia. William served as an Ensign in the militia in 1796, and received 400 acres on Buffalo Creek near Farmington (now in Marion County, West Virginia) from his father on June 19, 1797. 1790, private papers, Monongalia County. John Burroughs Jr., late of Cumberland River, North Carolina, and William Martin, of Monongalia County, entered into an agreement whereby Burroughs agreed with Martin to prosecute a suit Burroughs brought against David Scott in Monongalia County Court for a tract of land on the east side of the Monongalia River adjoining John Burroughs, Sr. and James Johnston "which said suit Martin doth oblige himself to carry on at his own expense and if he should win the suit" then Burroughs, Jr. agrees to give Martin one half of the land recovered. Martin to call upon Elijah Burris to chose two men and Martin to choose two men to value the land. Martin may keep the land, paying one half the value to Burroughs, Jr. or he may sell at public auction to the highest bidder and each getting one half. A penal sum of 300 pounds bound the parties to honor this agreement, 2 December 1790. Witnessed by Jesse Martin and Boaz Burrows. Signed by both parties. (Monongalia County Records page 91) On August 22, 1800, William was sued for 3£ 10 shillings in wheat or corn that Starling delivered to Bowen’s Mill on the Monongalia River for William on March 20, 1797 (to be paid by Christmas, 1797), and 20 bushels of corn that was to be delivered to Colonel Charles Martin’s house (payable April 20, 1794) (William paid the debts, and the case was dismissed). In October 1801, William was sued by William Sodgrass, because two years previous, William sold him a tract for $518 in notes, and Martin was to make good on the deed later. Martin left for nearly 2 years (on his Cumberland River excursion), and upon his return, Snodgrass asked him for the title. Presumably, William thought he would end up with this land through his father’s estate, but he came away with less than anticipated, so William refused Snodgrass, saying it was not in his power to give him the title. William agreed to cancel the contract, and return the notes. He returned all but one note that he had assigned to Samuel Everly. Snodgrass refused to pay the note off as William had reneged on the deed; Everly subsequently sued, and in 1801, won a judgment against Snodgrass. On April 6, 1801, William and Elizabeth deeded her portion of her father’s land in Monongalia County, Virginia to her brothers, William, Simon, and Jesse for $100.

Exert from the Nov. 04, 1798 will of Charles Martin naming William as his son. Will Book #1 p 304, Monongalia County, W. Va. "I also give to my son, Presley Martin, four hundred acres of land where I now live, excepting and reserving the aforesaid bequeathment to his mother during her mature life-time, and also one Negro boy called, Abraham, and one of the Negro girls bequeathed to his mother, after her death, or the increase of the Negro, Silvy, which my son Presley, is to have the choice, after his mothers death to him, the said Presley Martin, heirs and assigned forever. And lastly, as to all the rest and residue and remainder of all my real and personal property, goods and chatels of what kind and nature whatsoever, to be sold by my executives at public sale and the money arising therefrom after all my just debts are paid, and all other expenses is discharged, is to be equally divided between my son George Martin, my son William Martin, and my son Presley Martin, and my son Spencer Martin, and my daughter Elizabeth Randall and my daughter Ann Harrison and my grandson Charles Martin, and the son of Jesse Martin, as tenants in common and the money to be paid legatees within 2 years after my decease. I do hereby appoint my beloved wife, Mary Martin, executrix and Stephen Gapen of Dunkard Creek and my son Presley Martin executors of all this, my last will and testament. Hereby revoking all wills here by me made. In witness whereof, I have herewith set my hand and seal, this forth day of November, in the year of our Lord, one thousand seven hundred and ninety-eight. (Signed) Charles Martin (Seal)"
