Settled in Malden on the homestead, which he bequeathed to his sons Daniel and John by a non-cupative will.

Daniel, the father, devised the homestead to his two sons Daniel and John, the latter being the father of ^'John, of Leicester," by a nuncupative will. The dwelling-house was devised to Daniel. This will was not proved and allowed until nearly two years after the testator's death. His widow, Mary, was appointed administratrix, Nov. 18th, 1683.
Will. The following is a copy of the will:
Dat. 11th May, 1683, Charlestown, Middlesex.
Daniel Whitra>re being sensible he was neere unto deathe, but sound in his understanding; hee desired two persons undernamed to tiear what his will is : His will is That his wife shall have the thirds of all his estate during her life: and his will is that his eldest son Daniel should have his dwelling house with the land adjoininir to it from Belchars line to the Roak, that ip about ten pole to the norwest (if the pine iree : and that to be the breadth of It with the whole length of the land, and the rest of his land his will is that his son John should have it all: and his will concerning hismeadow is that his son Daniel should have three parts; and his son John should have two |>urts and his will is seven younger children shall have only eight pounds a piece except his eldest daughter Mary: and she should have ten pounds: and if one brother be at any time minded to sell any of this land, he shall not sell it from the other brother if he be minded to buy it
