Caroline Co., VA Court Order Book for 9 May 1741 of the Last Will and Testament of John Penn, deceased, being presented in Court by Elizabeth Penn and Moses Penn, co-executors and proved by John Taylor, Gent., and Edmond Taylor, witness thereto. They entered into bond with George Penn their security.

It is believed that our John Penn is the one who died in Caroline Co., VA in 1741 with a widow, Elizabeth, and son, Moses, named as coexecutors. Her surname is suggested as either Taylor or Madison, Madison seems the very most likely, their son George Penn witnessed the will of Ambrose Madison in 1732. Tidbits from the research of Robert Allen: John Pann is listed in the 1704 Quit Rent Rolls lists for King & Queen Co., VA as owing 200 acres.

John Penn, Sr., John Penn, Jr. and George Penn are listed in the Ambrose Madison Account Book covering the period of 1725-1726. Again, this is consistent with the John Penn who died in 1741 being John Penn, Sr., listed and the John Penn who married Mary and died in Spotsylvania Co., VA in 1773 being John Penn, Jr., listed and George Penn who married Ann and died young in Caroline Co., VA in 1749 being the George Penn listed.

"There is a commonly repeated story that Joseph Penn who married Mary Taylor and his suspected brothers, John, George and Moses Penn, were the sons of John Penn, born circa 1650 and Lucy Granville, the daughter of Sir Beverly Granville and Lady Jane Wyche (daughter of Phillip Wyche). I have seen no documentation which establishes the existence of a John Penn who married Lucy Granville or anybody by the name of Lucy. It says that this John Penn lived in Rappahannock and Westmoreland Counties, VA and died about 1721 and was the father of George, Joseph, John and Moses Penn. There is a 1721 Westmoreland Co., VA reference of a lawsuit of Joseph Taylor against the estate of John Penn. Perhaps this is the John Penn who married Lucy Granville but I have seen no proof the the existence of a John Penn who married Lucy Granville."
