James Smith, Caleb Smith, Abraham Smith & Ephraim Smith Exrs. of ye last Will & Testament of John Smith late of Milford decd., exhibited sd. instrument in this Court, ye Witnesses to which being sworn before Nathan Baldwin Esqr. Jus: peace, the same is accepted as provd., in Court & approved for Record. Exrs. accept said Trust.
In the Name of God Amen ye 2d Day of August A.D. 1750 I John Smith of Milford in the County of New Haven in his Maj.ies. Colony of Connecticut in New England in America & being advanced in years & calling to mind my approaching change by Death: & of sound mind & memory thanks be given to God, to make, constitute & ordain this my last Will & Testamt. in manner & form following, that is to say, principally & first of all, I recommend my soul into ye Hands of God that gave it, and my Body I recommend to the Earth, to be buried in decent Christian Burial at the Discretion of my Exrs. hereafter named, nothing doubting but at ye general Resurrection I shall receive the same again, by ye mighty power of God. & as touching such worldly Estate wherewith it hath pleased the Lord to bless me in this life, I give, devise & dispose of the same in ye following manner & form, after ye Payment of all my just Debts.
I Give & bequeath unto my Daughter Ruth Smith the sum of one hundred pounds or an equivalent thereunto out of my Chattel Estate according to ye apprisement thereof in such things as she shall chuse & also two cows & six sheep such as she shall chuse.
Item. My Will further is that my Daughter Ruth Smith shall have two hundred pounds more out of my Estate in money according to old tenor, to be paid by my Exrs. within one year after my Death, otherwise to have so much of my lands as shall be equivalent thereunto as shall be set out to her by Free Holders &c & also a Privilege to dwell in my h ouse, with so much room as she shall have occasion, so long as she continues unmarried.
Item. My Will is yt my three other Daughters, Sarah Beard, Phebe Platt & Mercy Gillil have thirty pound money according to old tenor apiece, paid to them by my Executors, within one year after my Decease.
Item. My Will further is that the rest of my household goods shall be equally divided between my four Daughters, Sarah Beard, Ruth Smith, Phebe Platt & Mercy Gillil, intending all the abovesaid Legacies to them & their Heirs for ever.
Item. I Will & true Intent is, yt my four sons, James Smith, Caleb Smith, Abrm. Smith & Ephraim Smith have all my Lands, Pastures, Meadows & appurtenances either in Milford or elsewhere equally to be divided between them, to them & to their Heirs & assigns forever, which I have not otherwise disposed of by Deed previous hereunto. Item. My Will further is yt my four sons above mentioned have all ye rest of my Chattel Estate, as husbandry Tools, stock &c upon condition their paying ye several Legacies above mentioned.
Item. My Will is, & I do hereby appoint, constitute & ordain my four sons, James, Caleb, Abram. & Ephrm. Smith to be Exrs. of this my last Will & Testamt. & I do hereby utterly disallow & disannul all & every other former Wills, testamts., Legacies & Bequests, or Exrs. by me [text missing due to a torn section] ratifying & confirming this & no other to be my last Will & [text missing due to a torn section] I have hereunto set to my Hand & seal ye day & year above written.

Prince & George Clark, ye 3d, all of Milford & made solemn oath, they saw John Smith Junr. decd., sign & seal the within Testamt. & yt they heard him pronounce & declare it to be his last Will & Testamt. and yt they judged at that time him to be of sound mind & memory, and they signed as Evidences in preference of the Testator & they each other sign as Evidences in preference of the Testator.
