Abraham Carle vs. Absolom Fisher and Juliet, his wife. (Filed Sept 21,1847.) Assumpsit. Plaintiff alleges that on April 1, 1839 in Highland Co., at the request of Juliet Fisher, "who was then sole and unmarried ..then Juliet Carl", he took her two infant children, Martha Jane Carl," aged 3 years and 5 months or there abouts at the time and John Carl aged15 months at the time", to raise and educate. He kept the girl for over four years and the boy for over 8 years. Defendant took her daughter on June 1, 1843 and her son on August 21, 1847, after she had married Absolam Fisher (record 8, page 338) (Compiler's note : In the original papers of this case is found the following: "Demand of the Children. August the 27th, 1847. I, Abraham Carle, do otheris in my affliction, Thompson McConaughey to demand of Absalam and Juliet Fisher, John and Martha Jane Carle, my grandchildren, or a reasonable price for bording clothing and schooling. I am willing to leave it to two discrete freeholders to say what that shall be. You may chose your corse if you do not chose to give them up pay me for thare rasing.
